DRAFT AGREEMENT DECLARING THE YEAR 2007 AS THE YEAR FOR THE
ENTRY INTO FORCE OF ACS LEGAL INSTRUMENTS
The Ministerial Council,
Considering:
the Convention Establishing the Association of Caribbean States and in particular
Articles XVI and XVII on the legal capacity and privileges and immunities of the
Association respectively;
Article XVIII of the Convention setting out the members’ general undertaking to
implement its provisions and to facilitate the achievement of the purposes of the
Organization;
Agreement No.7/06 of the Ministerial Council;
Bearing in mind:
Article 18 of the Agreement for regional Co-Operation in the Area of Natural
Disasters done at Santo Domingo de Guzman, Dominican Republic on April 17, 1999;
Article 25 of the Protocol on Privileges and Immunities of the Association of
Caribbean States, done at Panama City, Republic of Panama on December 13, 1999;
Article 9 of the Convention Establishing the Sustainable Tourism Zone of the
Caribbean, done at Margarita Island, Bolivarian Republic of Venezuela on 12
December 2001;
Article 8 of the Protocol to the Convention Establishing the Sustainable Tourism Zone
of the Caribbean, done at Panama City, Republic of Panama on 12 February, 2004;
and
Article 26 of the Air Transport Agreement Among Member States and Associate
Members of the Association of Caribbean States done at Panama City, Republic of
Panama on 14 February 2004

Cognizant of the provisions of the Declaration of Panama calling specifically on
Member States and Associate Members to sign and ratify the Convention Establishing
the Sustainable Tourism Zone of the Caribbean as well as the Air Transport
Agreement Among Member States and Associate Members of the Association of
Caribbean States;

To accept the Plan of Work prepared by the Secretariat and endorsed by
the Working Group for the Entry Into force of ACS Legal Instruments, and
to once again, call on all Members and Associate Members who have not
yet signed, ratified or otherwise consented to be bound by the instruments
set out above, to take the steps necessary to establish such consent to be
bound.
To accept the offer of the Depositary State, the Government of the
Republic of Colombia, to place the legal instruments at its Permanent
Representation to the United Nations in New York, in order to facilitate
their signature, with a view to depositing the Instrument of Ratification or
Acceptance as soon as possible thereafter.
To declare the year 2007 as “THE YEAR FOR THE ENTRY INTO FORCE OF
THE ACS LEGAL INSTRUMENTS,” and to urge Members and Associate
Members to fulfill their obligations under the said instruments as well as
Article XVIII of the Convention before December 31, 2007.
