Joel E. Cape is an associate in the firm and focuses his practice on agricultural
and agribusiness law, intellectual property, and products liability litigation. Mr. Cape’s
background and education in agriculture particularly enables him to understand the
unique legal issues in the industry. He originally hails form Northeastern Oklahoma
where he raised, showed, and marketed purebred beef cattle as member of his local 4-H
and Future Farmers of America chapters. Mr. Cape is familiar with laws that are
uniquely applicable to agriculture and agribusiness, including the Packers and Stockyards
Act, Plant Variety Protection Act, Perishable Agricultural Commodities Act, Federal
Seed Act, state seed laws, and state Right-to-Farm laws.
Representative Experience
 Represents a large agricultural biotechnology company in the national
enforcement of its intellectual property rights.
 Represented a large strawberry nursery in a products liability case which was
successfully removed to federal court and settled on terms highly favorable to the
client.
 Advised client on state seed laws, seed arbitrations, and Right-to-Farm laws.
 Represented clients in commercial disputes, landlord-tenant disputes, and general
tort matters.
