The Basis of Tenders: Tenders are invited for Graduation Photography and Gowns, to Buckinghamshire New University. 2. 3. 4. Contract Price: a) The Tenderer will submit a fixed price for each unit as detailed in the specification response. b) Each item listed in the Tender shall be priced independently of any other work and shall be the full inclusive value of the work described but excluding VAT. c) The prices quoted are to be in Pounds Sterling [£]exclusive of vat, format £a plus vat Instructions to Tenderers: a) Persons proposing to submit Tenders are advised to ensure that they are fully familiar with the nature of the obligations to be accepted by them if their Tender is accepted. Before tendering, the Tenderer must acquaint himself with the Request and the Terms and Conditions of Contract document. Any alternative conditions appended by the Tenderer, shall be deemed to have been rejected by the University except when expressly agreed by the University in writing. b) Tenderers should seek to clarify any points of doubt or difficulty with the University before submitting a Tender. David.shone@bucks.ac.uk Preparation of Tenders: a) Every Tender received by the University, shall be deemed to have been made subject to the terms set out in the Request or any subsequent amendment hereto. b) No employee or agent of the University has authority to vary any part of the Tender documents other than David Shone (Procurement Manager), who shall do so only in writing. c) The Tender must be on the Form of Tender incorporated herein. It must be signed by the Tenderer and submitted in the manner and by the date and time stated. d) The University is not bound to accept the lowest or any Tender. The University shall have no liability in respect of any claim, expense, cost or loss made or incurred by a Tenderer in respect of the preparation, submission and subsequent discussion or decision relating to a Tender. e) The successful Tenderer may be required to execute a formal agreement and, until the execution of that agreement, the successful Tender together with the University's written acceptance will form a binding agreement between the University and the successful Tenderer. f) 5. The Tender and all accompanying documentation are to be supplied in English. Instruction for Return of Tender: a) All the documents relating to the offer from the supplier and the other required paperwork must be sent to the following: David.Shone@bucks.ac.uk and should arrive no later than noon 7/1/14 The required method of transmission is electronically to david.shone@bucks.ac.uk . b) The University accepts no responsibility for any Tender delivered in any way other than that specified above. c) It is stressed that any Tender that is received after the above time and date for delivery cannot be considered and will be returned to the Tenderer. The University does not undertake to accept the lowest Tender, or part, or all of any Tender, and the acknowledgement of receipt of any submitted Tender shall not constitute any actual or implied agreement between the University and the Tenderer. The University reserves the right to accept any part, or all, of any Tender or Tenders at its sole discretion. The Contract will be awarded on the basis of the most economically advantageous offer, taking into account the following factors: service, delivery, price and reliability The Contract will be awarded on 17/1/14 on the basis of the most economically advantageous offer, taking into account the following factors: - Conformance to the University’s requirements and conditions. - The capability to meet the University’s needs as, when and where they arise. - The commitment to supply the University with a thoroughly professional service. - Evidence of how the Tenderer would provide personnel meeting the University’s requirements. - The Tenderer’s provision of sustainable Goods, services and processes. - The Tenderer’s financial position. - The service supplied to other customers requiring similar services within the University sector. - The cost to the University of the service offered. 6) Conditions of Contract: Payment terms are to be 30 days net. 7) Environmental Considerations: The supplier shall take action to minimise any adverse affect on the environment from the services used in the performance of this Contract or from their manufacture, storage and supply in accordance with current legislation and best practice. 8) Mediation: If any dispute or difference arises between the University and the Contractor in connection with or arising out of the Contract and provided that either of them shall have given to the other notice in writing thereof such dispute or difference shall be referred to as the Centre for Effective Dispute Resolution for resolution by mediation. Any such reference shall be deemed to be a submission for arbitration within the meaning of the Arbitration Act 1996 (unless otherwise specified in the Contract) or any statutory reenactment or amendment thereof for the time being in force. The Request Specification: The University holds between 9 and 10 graduation ceremonies in September each year. With the attendance at each such ceremony averaging 250 students and 40 academics. The provider shall attend each graduation ceremony with sufficient studio photographers to ensure an efficient and smooth operation. That only photographers who are members of the British Institute of Professional Photographers are utilised. Sufficient sales staff should be provided to ensure graduates and their families are dealt with smoothly and efficiently. All photographs to be posted to the graduate within 28 days and reorders of all photographs taken in various styles and finishes to be available. In addition the supplier should make available a process for ordering and delivering gowns to attendees of the ceremonies. Note: The tender allows for consortium bids or subcontracting to deliver the required service mix. The contract will be awarded for three years with the option for two further annual renewals.
