WHEREAS, the property conveyed is commonly referred to as the
Bulls Bay Preservation property; and

WHEREAS, on July 21, 2000, Wade conveyed a 4.34 acre light
8
industrial

(“Sumitomo”) by means of a Special Warranty Deed, attached hereto
10

to
Sumitomo
Bank
Leasing

Finance,

as Exhibit 3 and incorporated herein by this reference; and

WHEREAS, on that same date, Wade conveyed drainage easements

(the “Drainage Easements”) to Sumitomo and Bridgestone/Firestone,

Inc. (“Bridgestone”) over the easements area, a 2.74 acre parcel

installing, maintaining, repairing, and replacing underground storm
16
water drainage lines, together with an easement to discharge storm
17
water through such lines into the pond; and
