1. Background
Comments , in particular, the wording and intended scope of the notes after group C08G
75/0204, were invited in previous WGD (Annex 4).
Rapporteur thanks EP for her comments posted as Annex 5. It contained the comments
on the notes and titles and references in some subgroups.
2. Comments and Rapporteur proposal
Rapporteur updated the scheme (Annex 6) according to EP comments (Annex 5).
2-1. Notes after C08G75/0204
Rapporteur basically adopted the wording proposed by EP.
Regarding the beginning of the first set of groups in Note(s) 1 after C08G75/0204,
Rapporteur modified the subgroup to C08G75/0209.
Modified scheme would be interpreted that every structural feature of
polyarylenethioethers are to be classified within C08G75/0209-C08G75/0245 and subject
matters of polyarylenethioethers other than structure, preparatory processes, postpolymerisation treatment or chemical after-treatment would be classified in C08G75/0204.
Such subject matter could be, for example, properties of polyarylenethioethers.
2-2. Scope of C08G75/0213, C08G75/0222 and C08G75/0236
Considering the comment from EP, Rapporteur deleted “in the aromatic ring” in
C08G75/0213 and C08G75/222 and modified the title of C08G75/0236.
Rapporteur interpreted the scope of these groups as follows. Elements other than
carbon, hydrogen or sulfur in C08G75/0213 and C08G75/0222 can exist as elements in an
aromatic ring or in a substituent of an aromatic ring. On the other hand, elements other
than carbon or sulfur in C08G75/0236 exists in a linker bond between arylene groups.
For example, arylenethioether which has pyridine as arylene group is classified in
C08G75/0222. Arylenethioether which amino-substituted phenylene group as arylene
group is also classified in C08G75/0222. On the other hand, arylenethioether which is
obtained by thioether bond forming reaction with diphenyl amine (–Ph–S–Ph–NH–)n is
classified in C08G75/0236.
Rapporteur thinks that newly proposed title defines the scope of these subgroups,
precedence references are not necessary.
2-3. Scope of C08G75/0245
Regarding the precedence reference, Rapporteur thinks that the explanation by EP is
persuasive. Thus precedence reference is deleted.
EP also argues the relationship between subgroups in C08G75/02 and C08G75/12.
Since last place priority rule is basically applied in this main group, Rapporteur thinks that
multiple classification cannot be applied without clear statement in the scheme and the
precedence reference from C08G75/12 to C08G75/0245 is necessary.
Although this is not reflected in the scheme yet, Rapporteur is wondering whether
precedence references from C08G75/12 to any other subgroups in C08G75/02 are
necessary or not.
For example, where should polyarylenethioether-ether like (–Ph–S–Ph–O–)n be
classified, C08G75/0236 or C08G75/12? Rapporteur understands that it should be
classified in C08G75/12 in the current proposal because last place priority rule is applied.
If it should be classified in C08G75/0236, additional precedence reference (from
C08G75/12 to C08G75/0236 or C08G75/0204?) should be introduced.
Rapporteur would like to invite comments from offices on this point.
2-4. Definition of “main chain” and “in the aromatic ring”
Although Rapporteur understands the remark from EP, this time scheme is modified not
to involve these wordings to clarify the scope of each subgroup. Thus the definition of
these wordings is not necessary so far.
3. Scheme proposal
Clean version is submitted as Annex 6.
