in Miscellaneous Revenues and these moneys require appropriation;

WHEREAS, the U. S. Department of Housing and Urban Development

(HUD)
makes
available
Community
Development
Block
Grant
(CDBG)

funds to assist low- and moderate- income persons in Duval County,
22
Florida; and
23
WHEREAS, CDBG funds can be used for a number of activity types
24
within the county, including affordable housing, public services,
25
capital improvements, economic development, and the provision of
26
improved community facilities and services; and

WHEREAS, the City has $850,000 in unexpended CDBG funds from
fiscal year 2013 and these moneys require appropriation; and
WHEREAS, the City has $395,381 in reprogrammed CDBG funds from
fiscal year 2008 and these moneys require appropriation; and
WHEREAS, the City has $454,619 in reprogrammed CDBG funds from

fiscal year 2009 and these moneys require appropriation; and

WHEREAS, the Jacksonville Housing and Community Development
3
Commission (the “Commission”) has been designated as the agency to
4
provide
5

BE IT ORDAINED by the Council of the City of Jacksonville:
Section 1.
Appropriation. For the 2014-2015 fiscal year,
within the City’s budget, there are hereby appropriated the
indicated sum(s) from the account(s) listed in subsection (a) to
the account(s) listed in subsection (b):

Section 2.
Carryover.
The funds appropriated hereby
shall not lapse but shall carryover as appropriated funds from year
to year until such funds are expended or lapse according to the
originating state or federal housing program as applicable.
Section 3.
Purpose. The purpose of the appropriation set
forth in Section 1 is to expend the various accumulated
miscellaneous revenues as follows:
(a) $1,054,969 in Rehabilitation Loan Program Miscellaneous
Revenues for (i) U. S. 1 Infrastructure Improvements ($1,022,000)

and (ii) the Logan’s Hideaway Single-Family New Construction
Project to be developed by Wealth Watchers, Inc. and involving the
construction of up to ten (10) new homes;
(b) $1,064,031 from Homeownership For People Everywhere (Hope
III) Program Miscellaneous Revenues for (i) the Logan’s Hideaway
Single-Family New Construction Project ($57,031), (ii) Riverview
area infrastructure improvements ($625,000), and (iii) the Phelps
And Spearing area redevelopment of affordable housing to be
developed by Operation New Hope ($382,000);
(c) $940,000 in Urban Development Action Grant (UDAG) Program
Miscellaneous Revenues to the Logan’s Hideaway Single-Family New
Construction Project;
(d) $1,638,018 from Rental Rehabilitation Program
Miscellaneous Revenues to a redevelopment project to be called
Payne Street Redevelopment and to be developed by Northwest
Jacksonville Community Development Corporation; and
(e) $1,700,000 in Community Development Block Grant funds for
(i) infrastructure improvements in the Robinson’s Addition, New
Town, Paxon/Woodstock, North Riverside, Lackawanna, and Gran Park
neighborhoods within District 9 ($850,000) and (ii) infrastructure
improvements within District 10 ($850,000).
Section 4.
Authorization. The City of Jacksonville is
authorized to enter into contracts with third parties to expend
these funds in accordance with the respective program requirements.
Section 5.
Execution of Documents.
The Mayor, or his
designee, and the Corporation Secretary are hereby authorized to
execute and deliver any and all documents necessary to effectuate
the purpose set forth in Section 2 above. Because the United States
Department of Housing and Urban Development requires recipients to
comply with OMB Circular A-122 “Cost Principles for Non-Profit
Organizations,” and with Title 24 Housing and Urban Development CFR
Part 84 “Grants and Agreements with Institutions of Higher
Education, Hospitals, and Other Non-profit Organizations,” and hire
an independent certified public accountant to audit the program
(not to be funded from the grant moneys) in accordance with OMB
Circular A-110, the provisions of Chapter 118, Ordinance Code,
shall not be applicable to the City’s contracts to be awarded to
recipients. To the extent that a particular award/program does not
require compliance with OMB Circulars A-110 or A-122, or 24 CFR
Part 84, then compliance with Chapter 118, Ordinance Code, will
instead be required.
Section 6.
CIP Amendment. Ordinance 2014-467-E, being
the 2015-2019 Five-Year Capital Improvement Program for the City
and certain of its independent agencies, is hereby amended by
reducing funding for the project entitled “New Kings (US 1) Trout
River to Borden” in order to provide funding for the project
entitled “New kings Rd (US 1) I-295 to Garnette St”. The projects
are more fully described in the Project Information Sheets,
attached hereto as Exhibit 3 and incorporated herein by this
reference. The Council finds that the deferral of this amendment of
the CIP until the next annual budget and CIP review will be
detrimental to the best interests of the community because such
deferral could result in loss of funding. Pursuant to Section
122.605(c), Ordinance Code, enactment of this ordinance requires

the affirmative vote of two-thirds of the Council members present
at the meeting because of the CIP amendment set forth in this
section. This ordinance shall constitute an amendment to Ordinance
2013-465-E. In all other respects, the Five-Year Capital
Improvement Program approved by Ordinance 2013-465-E shall continue
in full force and effect.
Section 7.
Oversight.
The Department of Public Works
shall oversee the project described herein.
Section 8.
Effective Date. This ordinance shall become
effective upon signature by the Mayor or upon becoming effective
without the Mayor’s signature.
