I note that failure to observe the conditions could result in the issuing of a Penalty Charge Notice. I understand this permit does
not guarantee all pay and display bays now available will remain open for permit holders throughout the term of this permit. The
permit will only be valid on the vehicle(s) shown above and any alterations will be notified to Parking Services, PO Box 422,
Torquay, TQ2 5WU or parking.permit@torbay.gov.uk

1.
The Council will not be liable for any damage howsoever caused to any vehicle whilst parked in a Torbay
Council car park unless such damage is directly caused by any act of negligence on the part of the
Council.
2.
The Applicant must ensure that vehicles are positioned wholly within the markings of the car park bays and
not in such a position as to unreasonably interfere with or prevent the use of any access ways.
3.
The Applicant shall not permit any vehicle to park in a Torbay Council car park unless the vehicle is
licensed in accordance with the provisions of Section 1 of the Vehicle (Excise) Act 1962 and unless there is
in relation to the use of the vehicle by the Applicant a policy of insurance as to comply with the
requirements of Part VI of the Road Traffic Act 1972.

The Applicant shall not in any Torbay Council car park make any loud noise or cause or permit any
disturbance or annoyance to residents of the premises in the neighbourhood.
5.
The Applicant shall not use any part of the car parks or any vehicle left in the car parks for sleeping or
camping purposes or use the car parks for the purpose of servicing, cleaning or washing any vehicle other
than is reasonably necessary to enable that vehicle to depart from the car parks.
6.
The Applicant shall not transfer or permit to be transferred any fuel out of or into a vehicle except where
necessary to allow the vehicle to be driven.
7.
A valid Torbay Council Permit must be displayed at all times when parked in a car park. If a permit is not on
display, or has not been displayed correctly so that all the details annotated on the permit cannot be seen,
a Penalty Charge Notice may be issued.
8.
The permit may not be copied under any circumstances. The display of a copied permit will result in the
issue of a Penalty Charge Notice which will be liable for payment.
9.
Please note: The permit is only valid in pay and display car parks between the hours of 3.00pm and 10.00am.
10.
The car park permit is issued subject to the availability of a parking space and does not entitle you to any
precedence over other car park users.
11.
The instructions of Civil Enforcement Officers/Parking Services staff and relevant signs within the car parks
must be complied with at all times, this may include limited parking periods.
12.
No refunds can be given under any circumstances.
13.
The permit is only valid for use in the vehicle registration numbers specified to Parking Services.
14.
If a car park permit is lost or damaged, a replacement may be purchased at a cost of £20.00. You will be
required to fill in a separate application form which you will need to provide the original permit serial
number and expiry date, the date of purchase, the original receipt number and the length and type of
permit.
15.
Car Park Permits are valid in Torbay Council Off Street Car Parks only; they are not valid for use in any on
street pay and display parking places.
16.
Torbay Council will use any data provided within this application form for the issuing of parking permits and
will be used for automatic detection of outstanding enforcement notices. It may also be disclosed to other
departments within the Council or other external parties for related purposes or as required by law. All
processing of this data will be in accordance with the UK Data Protection Act 1998. For information
