ORDINANCE NO. 2001-10/9. AN ORDINANCE REQUIRING GARBAGE BAGS

PURCHASED FROM THE TOWN OR ITS AGENT WHEN DISPOSAL IS MADE AT

THE TOWN RECYCLING AREA. ALSO REQUIRING THE ATTENDANT TO BE

PRESENT FOR ALL DISPOSAL.

WHEREAS, the Board of Supervisors of the Town of Sherman finds household garbage is being left at the recycling site in bags or containers not purchased from the Town. This occurs when the attendant is not present.

WHEREAS, The Board of Supervisors has determined that the Town has lost revenue when garbage is left in the dumpster in non-authorized containers.

NOW, THEREFORE, the Board of supervisors of the Town of Sherman does hereby ordain and establish the following Ordinance.

SECTION 1: TOWN BAGS REQUIRED

All garbage disposed of at the Town recycling area must be in bags authorized by and purchased from the Town recycling attendant or the Springstead Trading Post.

SECTION 2: ATTENDANT MUST BE PRESENT

The Town Attendant must be present when any garbage is left at the Town recycling site.

SECTION 3: ENFORCEMENT

The Town recycling attendant and Town officer will enforce this ordinance.

SECTION 4: PENALTIES

Violations for each offense $100 to $300.

SECTION 5: EFFECTIVE DATE

This Ordinance shall take effect after passage and publication required by law.
