TOWN OF KAMSACK
BYLAW NO. 10/2002
Including amendments 01/2003, 20/2008, 22/2009
A BYLAW OF THE TOWN OF KAMSACK TO REGULATE THE COLLECTION OF
REFUSE IN THE TOWN OF KAMSACK. THIS BYLAW MAY BE CITED AS THE REFUSE
BYLAW.

The Council of the Town of Kamsack in the Province of Saskatchewan enacts as follows:
I.
GENERAL INTERPRETATION
For the purpose of this bylaw the following terms, phrases, words and their derivatives shall have
the meanings given herein.
a.
“Residential”
Any building or mobile home occupied or used as a place of living by not more than two
families.
b.
“Light Commercial”
i) any commercial entity that operates one (1) to three (3) days a week; or
ii) any commercial entity that operates four (4) to seven (7) days a week.
c.
“Heavy Commercial”
Any premises principally used for a business engaged in the following:
- sale of warehousing of groceries or perishable goods.
- operation of a restaurant.
- operation of a hotel or motel with licensed premises and/or restaurant.
- operation of a farm machinery and equipment dealership.
- operation of a gas bar and convenient store
- operation of a drug store
d.
“Institutional”
Any premises principally used for the following:
- Hospital
- School
- Nursing Home/Senior Citizen Lodge
e.
“Apartment Complex”
Any building or mobile home occupied or used as a place of living by
more than two families, living independently of one another.
f.
“Owner”
The registered or assessed owner or agent acting on behalf of the owner.
II.
g.
“Occupant”
Any person abiding in or conducting a business in any premises, dwelling or building.
h.
“Collector”
Any persons employed and/or contracted by the Town for collection and disposal of
waste.
i.
“Hazardous Waste”
Any waste materials designated by either the Environmental Protection Act, and/or the
Dangerous Goods Act of Saskatchewan and/or Canada.
j.
“Receptacle”
Means a container of watertight, rust resistant construction, having a smooth rim, rigid
fixed handles and a watertight cover.
COLLECTION AND DISPOSAL CONTROLS
a.
Collection Frequency
Collection services will be provided subject to modifications for holidays
as follows:

As per Schedule “A” appendixed to this bylaw.
c.
Collection Service Regulations
1. Residential Service
Refuse means any discarded organic or inorganic material which the owner or
occupant does not wish to retain subject to the following conditions:
all domestic refuse must be containerized in a proper receptacle, total weight must
not exceed 45 pounds.
branches or limbs up to 3/4 inch diameter will be accepted as long as they do not
exceed an overall length of 3 feet, are securely bundled and tied and the bundle
weighs 45 pounds or less.
grass clippings and/or garden refuse must be containerized in a proper receptacle.
residential service will be limited to four (4) receptacles per pickup. Extra
services can be arranged in accordance with Schedule A.
Unacceptable refuse is described as:
any refuse not conforming to the above outlined conditions.
cardboard and paper that can be recycled.
trees, branches, shrubs, hedges or limbs exceeding 3/4 inch in diameter.

sharp objects or broken glass not packaged for safe handling.
rocks, sod and/or earth and gravel
reconstruction debris resulting from building renovation or demolitions,
including fences.
any residue or refuse from burning or partial burning of a residential structure.
discarded furniture, automobile parts including tires, appliances, plumbing or
heating system parts or components, tanks of any nature.
any other wastes defined as hazardous in section 1.
2. Commercial Service (Light and Heavy)
Refuse means any discarded organic or inorganic material which the owner or occupant
does not wish to retain subject to the following conditions:
all organic refuse must be containerized in a proper receptacle, total weight must
not exceed 45 pounds, unless refuse is containerized in mechanically unloaded
dumpster.
light commercial service will be limited to four (4) receptacles of refuse per
pickup. Extra service can be arranged in accordance with Schedule “A” if
required.
heavy commercial service will be limited to eight (8) receptacles per pickup.
Extra service can be arranged in accordance with Schedule “A” if required.
Unacceptable refuse is described as:
any refuse not conforming to the above outlined conditions.
cardboard and paper that can be recycled.
trees, branches, shrubs, hedges or limbs.
sharp objects or broken glass not packaged for safe handling.
rocks, sod and/or earth and gravel.
construction debris resulting from building renovation or demolitions,
including fences.
any residue or refuse from burning or partial burning of a commercial
structure.
any residue or ashes from any burning container
discarded furniture, automobile parts, including tires, appliances, plumbing or

any quantities in excess of allowed volumes in either light or heavy
commercial categories.
3. Institutional Service
Refuse means any discarded organic or inorganic material which the owner or
occupant does not wish to retain subject to the following conditions:

not exceed 45 pounds, unless refuse is contained in mechanically unloaded

institutional service will be limited to ten (10) receptacles per pickup.
extra service can be arranged in accordance with schedule “A” if required.

sharp objects or broken glass not packaged for safe handling.

any potentially infectious refuse.
any quantities in excess of allowed volumes in Institutional category.
d.
Hopper Container Service
The collector can provide hopper type garbage containers for commercial and
institutional service categories, as outlined in schedule “A”.

III.
ORDER AND PENALTIES
a.
Front Pickup Service - Winter Season
Notwithstanding other provisions within this bylaw, Town Council may, by
advertisement in the local paper or the normal utility bill, order the owner or occupant in
specified areas or premises within the Town of Kamsack to place waste containers on the
boulevard area abutting the premises for the time of waste collection.
b.
Spring/Fall Clean Up Programs
Notwithstanding other provisions within this bylaw, Town Council may at their
discretion, advertise or proclaim special spring or fall clean up programs clearly outlining
the nature and types of refuse that will be collected.
c.
Incineration of Refuse
Incineration of refuse within the Town of Kamsack or at the landfill site is
prohibited. The collector may burn specified refuse subject to the Municipal Waste
Management Regulations.
d.
Operation and Control Landfill Site
The operation and control of the Landfill site shall be directed at the discretion of Town
Council. They retain the sole authority to implement any measures required to control its
operation.
e.
Refuse Container Location
Notwithstanding other provisions within this bylaw, refuse containers may not be located
in front or side yards abutting a public right of way. Where there is a lane abutting the
rear or side of the premises containers shall not be more than six (6) feet from the lane,
nor shall they encroach on the lane impeding traffic or pickup service. In cases where
this section of the bylaw cannot be complied with, the owner or occupant shall place
waste containers on the boulevard area abutting the premises.
f.
Private Collection Contracts
The collector may enter into a contract with any owner or occupant for collection of
whole or part of any refuse within the Town of Kamsack.
g.
Notice Served
Town Council shall issue any orders deemed necessary for effective enforcement of this
bylaw. Notice will be served to the owner or occupant with copies to the registered
owner. In any case where an order is not carried out, refuse will be removed at the
owners or occupants expense by the collector, subject to rates outlined in Schedule “A”.
If the amount payable is not paid on or before the 31st day of December of the year the
work was completed, the amount or part thereof remaining unpaid will be added to and
form part of the taxes on the owners property, as provided for in The Urban Municipality
Act.
h.
Provision for Extra Service
Notwithstanding other provisions within this bylaw extra pickup service can be provided
to any owner or occupant in accordance with Schedule “A”.
i.
Bylaw Repeal
Bylaw 13/99 is hereby repealed.
j.
This bylaw shall come into effect on the 21st day of June, 2002.

HOPPER CONTAINER RATES
All hopper leases are subject to completing a lease agreement with the collector. The rates are as
follows:
(a) 2 cubic yard hopper
$15.00 per month plus GST
(b) 3 cubic yard hopper
$20.00 per month plus GST.
The rates for residential customers are as follows:
(a)
2 cubic yard hopper $15.00 per week plus GST and
$15.00 for each hopper dump.
(b)
3.
3 cubic yard hopper
$20.00 per week plus GST and
$20.00 for each hopper dump.
EXTRA SERVICE RATES
RESIDENTIAL
Extra services can be provided subject to arrangements being made through the
Municipal Town Office and Director of Public Works. Hourly rate is $75.00 per
hour which includes 2 men and necessary equipment. Minimum charge $40.00.
COMMERCIAL
Extra services can be provided subject to arrangements being made through the
Municipal Town Office and Director of Public Works. A minimum charge of
$20.00 per month for each additional weekly collection shall apply.
