for apportionment of motor vehicle registration fees to a new County Improvements for
Roads and Bridges Fund. The measure. Interest received on investments from funds in
the County Bridge and Road Improvement Fund, the County Road Machinery and
Equipment Revolving Fund, a new High Priority State Bridge Revolving Fund would
be required to be deposited in the County Improvements for Roads and Bridges Fund.
The bill makes the State Transportation Fund a continuing fund, not subject to fiscal
year limitations, to be used for the construction, repair and maintenance of state
highways. It appropriates $270 million to the Department of Transportation. The
measure annualizes the $70 million debt service in bonds that ODOT is paying..
Commentary: 1. Creates a new fund at ODOT called “County Improvements for
Roads and Bridges Fund”.
(i)Funds for County Roads and Bridges, 85 million once fully implemented.
(ii)Funding from the State’s General fund (Motor Vehicle Collection tax) will be
phased in “thirds” (5%) starting in state 2008 fiscal, July 1, 2007. For the 2009 State
fiscal year it will be 10%. For the 2010 fiscal year and thereafter it will be 15%.
(iii)Funding is divided equally between the 8 ODOT Field Divisions.
(iv)Policies and Procedures developed by the ODOT Transportation Commission.
(v)Projects must be on county’s five year plan and let by ODOT.
(vi)Counties may receive annual funding that may accumulate for up to 5 years to fund
expensive projects.
2.Interest earned stays with the following funds: County Road Machinery and
Equipment Revolving fund, the High Priority State Bridge Revolving fund, and the
County Improvements for Roads and Bridges fund.
3.Interest earned from the County Bridge and Road Improvement fund shall be credited
to the Circuit Engineering District Revolving Fund.
4.Removes the diversion of $200,000 off the top of the gasoline tax that was going to
the Education Reform Revolving Fund.
5.Removes the “Cap” from gross production tax on oil at 4% or 7% that goes into the
County Bridge and Road Improvement fund.

million to public safety, $672.7 million to human services, $448.1 million to general
government and transportation, $146 million to natural resources and $15.5 million to
Rural Economic Action Program (REAP). The appropriation includes an across-theboard $3,000 pay raise for public school teachers and a funding increase of $130 million
for higher education

repair of a public building or structure that requires a surety bond or irrevocable letter of
credit. The measure modifies the Public Competitive Bidding Act of 1974 to require that
public construction contracts all public construction contracts exceeding $50,000 be
awarded to the lowest responsible bidder, by free and open competitive bidding after
solicitation for sealed bids. No work could be commenced until a written contract is
executed and all required bonds and insurance have been provided by the contractor to
the awarding public agency. Contracts of less than $50,000 would be awarded to the
lowest bidder by receipt of a written responsive bid from a minimum three bidders. All
bids would be required to be time and date stamped upon receipt at the office of the
awarding agency. Contracts for less than $5,000 for minor maintenance or minor repair

expensed by county jails for persons arrested or detained for an alleged crime; taken into

physical custody of a jail facility, held in the physical custody of a jail as a result of a
criminal conviction or pending disposition of a criminal case or coming into contact
with a law enforcement officer and not arrested, detained or taken into custody for a
crime. The measure requires the task force to submit written recommendations to the

Paraphrase: SB1938, by Sen. Kenneth Corn, D-Poteau and Rep. Gus Blackwell, RGoodwell, prohibits a portable scale used at any location other than an official weigh
station by the Department of Public Safety or the Corporation Commission to weigh any
vehicle transporting grain from being located within two highway miles of a commercial
grain elevator. The prohibition would not apply to such a vehicle that is involved in a
collision, being subjected to a Commercial Vehicle Safety Alliance (CVSA) inspection
by DPS or operated on any highway of the national defense highway system. The
measure creates an Oklahoma Highway Remediation and Cleanup Services Act to
provide for the Department of Environmental Quality to license, supervise, govern and
regulate highway remediation and cleanup services and highway remediation and
cleanup service operators in the state. The board would be required to adopt rules that
state the requirements for facilities, for storage of vehicles, the records to be kept by
operators and liability insurance and other insurance or bonding requirements to
adequately protect the interests of the public. The measure specifies licensure and other
requirements for highway remedian and cleanup services. DEQ would be required to
keep a current list of licensed highway remediation and cleanup service operators and
forward the list to the Department of Public Safety for distribution to wrecker service
operators licensed by DPS. DEQ would be required to update the list regularly to delete
operators whose licenses have been suspended or revoked. (Amended by House,

that portable weight limit scales can not be placed within 2 miles of a grain elevator.

Review of HB 1176XX
1. Creates a new fund at ODOT called “County Improvements for Roads and Bridges Fund”.
a. Funds for County Roads and Bridges, 85 million once fully implemented.
b. Funding from the State’s General fund (Motor Vehicle Collection tax) will be phased
in “thirds” (5%) starting in state 2008 fiscal, July 1, 2007. For the 2009 State fiscal
year it will be 10%. For the 2010 fiscal year and thereafter it will be 15%.
c. Funding is divided equally between the 8 ODOT Field Divisions.
d. Policies and Procedures developed by the ODOT Transportation Commission.
e. Projects must be on county’s five year plan and let by ODOT.
f. Counties may receive annual funding that may accumulate for up to 5 years to fund
expensive projects.
2. Creates a new fund at ODOT called “High Priority State Bridge Revolving fund” for State
Highway bridges.
a. Funding from 1.625% of the Gasoline tax and 1.39% of the Diesel tax that was going
to the State’s General fund.
3. Interest earned stays with the following funds: County Road Machinery and Equipment
Revolving fund, the High Priority State Bridge Revolving fund, and the County
Improvements for Roads and Bridges fund.
4. Interest earned from the County Bridge and Road Improvement fund shall be credited to
the Circuit Engineering District Revolving Fund.
5. Removes the diversion of $200,000 off the top of the gasoline tax that was going to the
Education Reform Revolving Fund.
6. Removes the “Cap” from gross production tax on oil at 4% or 7% that goes into the
County Bridge and Road Improvement fund.
7. Changes the State Transportation Fund into a revolving fund not subject to fiscal
limitations.
8. ODOT shall create an on-line mapping system for the highway systems in this state.
9. Increases funding for ODOT’s “Rebuilding Oklahoma Access and Driver Safety fund.”
Note: Only items “7” and “8” go into effect July 1, 2006. All other items are not effective until
July 1, 2007.
