232 STORE CATTLE
11.30 am - Auctioneer: Chris Voyce
Phew!!! What a wonderful demand. More cattle forward due to the mixed
indifferent weather, with more Vendors returning to Cirencester following the
Blue Tongue restrictions. Younger cattle attracted considerable interest with
Richard Newman’s Simmental x Blonde heifers to 176p per kg.
107 steers averaged £459 (£200 - £885)
122 heifers averaged £455 (£198 - £870)
3 Bulls averaged £460
There was a distinct shortage of stronger steers and heifers today but those
forward in keeping with rising beef trade sold exceptionally well.
More cows and calves and stores needed to meet demand. Remember
October and November always come too soon. Therefore don’t leave
marketing your cattle to long.
Some of the large consignments today included 34 suckled Simmental x steers
and heifers (Sept 07) from Richard Newman, Berkeley selling to £550 and
£540 (157) for steers and £530 (144), £530 (176) for heifers.

TB VALUATIONS
Many farmers will now be aware of the successful court case of Mr Partridge in
Devon who successfully challenged the level of compensation he had received for
his livestock. His lawyers successfully proved that the tabular system of valuation
discriminated between farmers and was contrary to English and EU Law.
Mr Partridge challenged on the basis that his cattle were worth three times the
table value figures whereas DEFRA argued that the table prevented the problem of
over compensation and was easy to administer. DEFRA also accepted that for
some animals the valuation was significantly less than their market value but this
“under compensation” only affected a very small number of animals. DEFRA also
argued that farmers should acquire “private” insurance to fill the “valuation gap”;
I am sure this will generate a number of laughs in the farming community similar
to the laugh achieved when you rung your broker and tried to buy insurance for
losses under foot and mouth!
The judge decided firstly on insurance that it was unfair on farmers with higher
value animals to suffer the cost of this insurance when lower value herds do not
and in line with my comments above, such insurance is unavailable and if it is you
would need to re-mortgage the farm to afford it.
Subject to any appeal from DEFRA the judge indicated that higher value animals
will have to be valued differently and that a difficult argument could follow to
decide the definition of what is a higher value animal (particularly considering the
current commercial trade) and should it or should it not be valued.
So what are the options available to you?
Mr Partridge can now claim the full value of his cattle and has/will utilise the
services of his valuer.
Farmers who have issued proceedings awaiting the outcome of this case can now
progress to claim.
Farmers who have in the last 3 months received an unfairly low valuation should
consider issuing judicial review proceedings.
Farmers whose valuation extends beyond 3 months of the case could consider a
case against DEFRA, Our advice, particularly in the case of Pedigree cattle is that
you liaise initially with your lawyer and weigh up the costs against losses.
Secondly, instruct your valuer to undertake an historic valuation of cattle
previously lost or make sure that whilst the table valuation scheme is still operative
you undertake a private valuation. Voyce Pullin can undertake such valuations on
your behalf providing useful evidence should you undertake proceedings. For
further information and to discuss costs, please contact Jon Pullin in the first
instance 07736 800760.
