PLANNING ACT 2002 – REJECTION OF A PROPOSED VARIATION TO THE NORFOLK
ISLAND PLAN
Resumption of debate (Mr Gardner, Minister for Tourism and Health) from 28 April 2009 on the
question – That the motion be agreed to, namely THAT in accordance with subsection 12(4) of the Planning Act 2002, this House resolves
that the draft plan laid before this House, being a proposed variation to the Norfolk Island
Plan approved by the Legislative Assembly on 25 February 2004 and last amended on 5
September 2008, and deemed to be the Plan under section 8 of the Planning Act 2002, be
rejected

“That for Item 6 of the Schedule the following be substituted―
6. New subsections
Insert new subsections 13(4) and (5)―
“(4)
Notwithstanding subsections (1) and (2A) a permit must not be issued
to import apples other than fruit grown in and imported from Australia or another
place approved by the Administrator by notice in the Gazette.
(5)
A person must not import into Norfolk Island any plant or fruit unless
it―
(a) has been specifically; or
(b) is a member of a class,
approved for importation by Regulation; and
(c) the foregoing provisions of this section have been complied with.”
