Objects will be considered for acquisition to the permanent collection if the following criteria are met: a) They relate to the natural, social, cultural, political, or economic history or prehistory of the peoples of Wyoming; or are representative of the types of material culture common to Wyoming. b) They are in good physical condition. c) They are of a size that the Department can provide proper storage, protection, conservation and preservation. d) They are significantly different in history, design, or condition from similar objects already in the collection. e) They are of value in relating the history of Wyoming and its people to current and future generations f) They are offered by a donor with no restrictions as to research, exhibit, loans, or conservation. DONATIONS 1) Donations to the State of Wyoming cannot be appraised by a staff member. 2) The donor must have clear title to the donated objects. Following acceptance, this contract shall be signed by the owner, Museum Supervisor, and Division Administrator, transferring ownership to the Department of State Parks and Cultural Resources of the State of Wyoming. It is policy to utilize donated objects(s) at the location within the Wyoming State Museum/State Historic Site system where they can best be interpreted within existing interpretive plans. 3) Multiple types of object collections are maintained by this agency. The right to change disposition of donated objects is reserved by the Department of State Parks and Cultural Resources. The Administrator of the Cultural Resources Division will approve changes to the collection category. 4) With or without full copyright transfer, the Wyoming Department of State Parks and Cultural Resources retains the right to reproduce images of the object(s) for educational, catalog, and/or publicity purposes. This document also acts as a waiver of rights of attribution. By signing this form, the donor authorizes the Wyoming Department of State Parks and Cultural Resources, or its designated representatives, to make modification(s) deemed necessary for the conservation, preservation, or stabilization of the object(s). If the object(s) is an original work of art, such modifications may be made provided they do not alter the artist’s original intent. Applicable Law/Venue The construction, interpretation, and enforcement of this Donor Form shall be governed by the laws of the State of Wyoming. The Courts of the State of Wyoming shall have jurisdiction over this Donor Form and the parties, and the venue shall be the First Judicial District, Laramie County, Wyoming. The parties intend and agree that the State of Wyoming the Department of State Parks and Cultural Resources and the Wyoming State Museum do not waive sovereign immunity by entering into this Form and specifically retain immunity and all defenses available to them as sovereigns pursuant to Wyo. Stat. Ann. §1-39-104(a) and all applicable law. Sovereign Immunity The State of Wyoming, the Department of State Parks and Cultural Resources and the Wyoming State Museum do not waive sovereign immunity by entering into this form and each of them specifically retains all immunities and defenses available to them as sovereigns or governmental entities pursuant to Wyo. Stat. Ann. §1-39-101, et. seq., and all other applicable law. Designation of venue, choice of law, enforcement actions, and similar provisions should not be construed as a waiver of sovereign immunity. Indemnification The Donor shall indemnify, defend, and hold harmless the State of Wyoming, the Wyoming State Museum, and the Department of State Parks and Cultural Resources, and their officers, agents, employees, successors, and assignees from any and all claims, lawsuits, losses, and liability arising out of Donor's failure to perform any of his/hers duties and obligations hereunder.
