The undersigned, as Proposer, hereby declares that the only person or persons interested in this
Proposal as principal or principals, is or are named herein and that no person other than herein
mentioned has any interest in this Proposal or in the Contract about to be entered into; that this
Proposal is made without connection with any other person, company or parties making a
Proposal; and that it is in all respects fair and in good faith without collusion or fraud.
The Proposer further declares that all conditions pertaining to the place where the work is to be
done; the Plans and Specifications for the work; and other Contract Documents relative thereto,
including the Request for Proposals, Instructions to Proposers, Proposal Bond, Form of Contract,
Performance and Payment Bond Forms, General Provisions, Special Conditions, Federal
Requirements, and the Technical Specifications plus all of the Addenda furnished prior to the
opening of the Proposals, as acknowledged below; has been thoroughly reviewed and is satisfied
relative to the work to be performed, and the time within which it is to be completed.
The Proposer agrees, if the Proposal is accepted, to contract with the Raleigh County Airport
Authority, in the form of Contract attached, subject to modifications proposed by the Proposer and
acceptable to the Airport Authority, to provide all necessary materials, equipment, machinery, tools,
apparatus, means of transportation, and labor necessary for the design, engineering, manufacture,
fabrication, delivery, complete installation, performance verification, testing, and training for one
(1) complete Avian Radar System and to maintain this system thereafter for a three (3) warranty
period, all in accordance with the Contract Documents.
And the Proposer further agrees not to withdraw this Proposal for a period of ninety (90) days after
the scheduled closing time for the receipt of Proposals, and that in case of failure on his part, should
they be awarded the Contract as best Proposer, to execute the said Contract and furnish the said
Bonds within five (5) days after the prescribed forms are presented for signature, the check or
Bond accompanying this Proposal and the money payable thereon, shall be paid into the funds of
Raleigh County Airport Authority; otherwise, the check will be returned to the Proposer.
The Proposer agrees to accept as full compensation for the work, completed in accordance with the
Plans, Specifications and other Contract Documents, the amount indicated in the Proposal Form as
the Total Proposal Price including the cost of the prescribed Performance and Payment Bonds, each
in an amount not less than the total Contract Price and all other items applicable to the cost of the
work.

Part 2 - Proposer’s Qualifications
A.
QUALIFICATIONS REQUIREMENT
Proposals will be considered only from qualified Proposers. To be qualified, the Proposer shall
provide qualification data that describes the following criteria:
1.
The Proposer, at the time of the proposal submittal, shall have been qualified to supply the
system as set forth in the Technical Specifications. Failure of the Proposer's to demonstrate
this capability shall render this proposal non-responsive.
2.
The Proposer shall have been regularly and continuously engaged in the design. manufacture,
fabrication, installation testing and maintenance of similar Avian Radar Systems specified
herein for not less than three (3) years immediately prior to the date of the scheduled Proposal
Opening.
3.
The Proposer shall have in their employ, as of the date of the scheduled Proposal Opening,
trained professional, technical and maintenance personnel with experience in the installation,
testing, and maintenance of this type of equipment.
4.
The Proposer shall have in operation adequate shop and storage facilities equipped to prepare,
deliver, test, and maintain this type equipment. The Proposer's Proposal shall include
descriptive information on the facilities available.
B.
QUALIFICATION DATA:
1.
The Proposer shall provide data substantiating the above qualifying experience and other data
as requested. Failure to submit the requested information will be cause of rejection of the
Proposal. The Proposer may supplement these pages with their own forms and attachments
and any other information considered pertinent to the evaluation of this Proposal.
2.
Proposer's personnel listed and for whom resumes are submitted shall be the personnel
actually assigned to these various functions by the Proposer. No substitutions from the
personnel submitted with the Proposal will be permitted unless with just cause and only after
approval of the change is requested in writing and accepted by the Airport Authority. Any time
lost in substituting personnel shall be made up at the Contractor's expense including
expediting, overtime expense, air shipment expense, etc., as necessary to complete each phase
of the project as scheduled.
C.
PROJECT SCHEDULE:
Proposers shall include a detailed Proposed Project Schedule which demonstrates their
schedule for completing the work within 120 Days from the Notice to Proceed”
