Winterization payment is due at time of service. If for any reason your invoice is not paid within 14 days, we will automatically
charge the invoice to your credit card.
Terms and conditions:
1. All payment made hereunder, including the deposit, are non-refundable, regardless if owner actually utilizes the space.
2. The undersigned customer authorizes the above work to be done, along with the necessary materials, and hereby grants Mermaid’s
Cove Marina LLC and its employees permission to operate the boat or engine for the purpose of testing and/of inspection.
3. An express mechanics lien is hereby granted and acknowledged on the above boat or engine to secure the amount of repairs.
4. Mermaid’s Cove Marina is not responsible for loss or damage to articles left on boat.
5. Mermaid’s Cove Marina is not responsible for fire, weather, theft of or damage to your boat while on our property, including canvas
tops and enclosures, whether caused by acts of nature, or negligent or unwillful damage by marina employees or customers.
6. Customer is to insure his boat against all damage and casualty.
7. No outside labor will be allowed to work on storage boats. Only boat owners may work on their storage boats with the following
exception: water storage boats are required to be winterized by Mermaid’s Cove Marina. Service of specialists may be arranged
through the marina office. Billing will be through the marina office with commission retained by the marina to compensate for use
of its facilities. When working on own boat, owner shall adhere to all DEP/EPA regulations regarding use of hazardous materials. All
materials brought by owner to marina for use on their boat must be removed from yard, including empty containers. Owner agrees
to remove all cans, tape, used oil, fuel, antifreeze, or any other materials from marina property each day when leaving. NO
materials shall be placed in marina trash or left on premises. If materials are not taken from yard, a cleanup and disposal fee of
$100.00 shall be charged to credit card.
8. Any boat arriving on or after November 22, 2014 will have a 10% increase on all storage and winterization charges. Mermaid’s Cove
will not be held liable for any damage to engine or any other systems or canvas damage for boats arriving after this date.
9. In the event of heavy snow fall you will be billed the current labor rate to remove the snow from your boat.
10. Wet storage boats are for storage only. No live aboards, no electric heaters, and no work will be performed on boats while being
stored.
11. Any wet storage boats not staying with us for the summer season will be required to leave by April 15, 2015. No exceptions. Any
boat here after April 15, 2015 will be subjected to a $5.00/ft per day storage charge.
12. I agree that boat shall be launched at the end of storage term or I will be charged summer storage at a rate to be determined.
13. Boat Relocation: Owner consents and agrees that the boat yard may move owner’s boat to a different location, berth, or mooring,
in the normal course of the boatyard’s business as may be considered necessary. Particularly in the event of inclimate weather such
as an impending hurricane.
14. Insurance: Owner will obtain and pay for general comprehensive public liability insurance insuring MMC as additional named
insured and the owner against loss from liability for damaged on account of loss or injury suffered by any person or property within
or upon the boat yard, the coverage and protection of such insurance to be in the amount of $1,000,000.00 per incident. Owner
agrees to provide MMC with a certificate of insurance and copy of insurance policy confirming the coverage.
15. Emergencies, Hurricanes, and Other Acts of God: Owner shall be responsible for making suitable arrangements for safe, sheltered
anchorage during storms and hurricanes. Owner warrants such arrangements have or will be made. Owner may not assume that
the boat yard will be safe, sheltered anchorage during storms and hurricanes. In the event of an impending storm of hurricane or
other emergency, in the event MMC is unable to contact the owner and/or the owner is unable to act in a timely manner, MMC, in
its sole discretion, is authorized to do whatever MMC deems appropriate and reserves the right in its sole discretion to move or
evacuate unattended boats at the owners risk and expense. MMC UNDERTAKING TO MOVE OR EVACUATE BOATS SHALL NOT BE
DEEMED AN ASSUMPTION OF RESPONSIBILITY FOR THE SAFETY, SECURITY, OR CARE OF BOATS, NOR THE CREATION OF A BAILMENT.
Owner assumes all risk of loss for his boat while stored in the yard, regardless of the circumstance.
