2. “Houston suburb considers expanding its impact fee waiver” (Adair&
Myers) When a person is starting a new business, there are many things it
is important for them to be aware of. One such thing is what ordinances
regarding businesses are in place in the municipality they are planning to
locate their new business in.
One reason for this is that it can help a new business owner know what
they need to do to keep their new business in compliance with the various
business-related laws of the municipality. Falling out of compliance with
such ordinances could expose a business to costs and legal problems.
Another reason is that what the business-related laws of a municipality are
could perhaps have impacts on some of the decisions that generally come
before a person as they are starting a new business, such as the decision of
where exactly to locate their new business.
One of the things business-related laws in a municipality sometimes regard
are fees for businesses. Currently, a Houston suburb is thinking about
making changes to a fee-related law it has.
The suburb in question is Tomball. In Tomball, one of the types of fees that
a new business that is locating in the city's downtown area can end up
being assessed are impact fees. These fees are aimed at helping with
dealing with water/sewer system impacts and drainage.
However, the city does have an ordinance in place which waives impact
fees for new businesses that locate in a certain area of the downtown.
Currently, a proposed ordinance is before the city which would expand the
area of the downtown that is covered by this waiver. It is anticipated that a
decision will be on made this proposed expansion in June.
What fees a given new business could face in connection to locating in
different areas could potentially impact what areas it would be financially
feasible for the new business to locate in. This is one of the reasons why
fee-related laws can be an important thing for a person who is starting a
new business to be aware of.
Business law attorneys can help individuals who are trying to get a new
business off the ground with being informed when it comes to the
business-related laws of the municipality where they intend to locate their
business.
