Introduction

04. This report has been drafted in order to request a pre-application statement from Marine Scotland
under the Marine Licensing (Pre-application Consultation) (Scotland) Regulation 2013 for the new
ferry terminal at Brodick, on the Isle of Arran . As per the requirements detailed in the Regulations,
this Technical Note details the following:
1. A location map and plan of the proposed development that will be the subject of the marine
licence application;
2. A description of the proposed development and its possible effects on the environment; and
3. Further representations considered relevant.
05. The latter point summarises the pre-application consultation undertaken during the development
of proposals since December 2012. A case is presented of on-going consultation with the
stakeholder group since this time, and through the application of various other consents, that
would offset the requirements under the regulations thereby permitting a marine licence
application in March ahead of a further stakeholder meeting schedule in June.

Description of the Proposed Development
06. The proposed development is located at the existing Harbour at Brodick on the Isle of Arran (see
Figures 1, 2 and 3). The project aims to provide lifeline ferry services and support economic
development on Arran for the next 60 years. Brodick Pier was converted to ro-ro operation with
the installation of the linkspan, causeway and other structures in 1972. The ferry terminal
infrastructure at Brodick is now nearing the end of its serviceable life. The preferred option is
highlighted in Figure 3. The development will consist of the following elements:

A finger pier of open construction;

An approach structure of solid construction incorporating a fixed ramp and bank seat for a
linkspan;

A linkspan and supporting dolphins;

Dredging;

Reclamation of foreshore;

Various onshore terminal buildings and access arrangements;

Surfacing, service drainage and area lighting; and

Demolition of the existing pier structures
Possible Effects on the Environment
07. The following possible effects have been highlighted through consultation with stakeholders:
08. The site is considered, through the results of a phase 1 habitat survey, to be of low ecological
value, although important ecological receptors have been recorded adjacent to the site. This
includes a breeding otter holt, which will require protection, possibly under licence, during the
works (i.e. avoid working at dawn and dusk, provision of a buffer zone).
09. There is evidence of nesting birds on the existing pier adjacent to the proposed works site. It is
recommended that no works occur within the area of potential impact to breeding black
guillemots during the breeding season (April to August inclusive) as any disturbance may deter
black guillemots from the area and prevent them from nesting.
10. The WFD assessment has been undertaken and concluded ‘The proposed new pier will have no
significant effects on any biological, hydromorphological, physico-chemical or chemical quality
elements in the East Arran Coastal water body.’
11. The BREAMM Noise Assessment has been undertaken and concluded – ‘The construction noise
assessment indicates that there is a potential for disturbance to neighbouring properties when
construction activities are being carried out at the closest, southern site boundary. However, it is
important to bear in mind that any potential impact is only short term, through the duration of the
works. Furthermore, it is understood that construction works are only planned during day-time
hours.’

Further Information
12. Consultation has been actively managed throughout the development of the project and is
planned to conclude with a stakeholder meeting scheduled for June 2015. In this meeting
appointment of the contractor will be announced and the proposed construction methodology
and programme presented.
13. Construction is planned to commence in July 2015.
14. Detail of ongoing consultation between the stakeholders and public is provided in Table 1.
15. Three other licence formal consultations/applications have been undertaken since September
2013 as outlined below, with stakeholder engagement and a formal opportunity provided for
Stakeholders to engage and influence the development of the project:

An EIA scoping decision was requested and received. Sept 2013;

A Harbour Revision Order was applied for in May 2014 and approved February 2015; and

A building Warrant application was submitted to North Ayrshire Council in November 2014
and is currently being determined
16. Advice has been received that the absence of a formal Stakeholder meeting held within the 12
months prior to the submission of a Marine Licence application prevents the submission of that
application. As outlined in e-mail correspondence between Marine Scotland and CH2M HILL on
the 23rd February, the need to undertake a pre-application consultation meeting is questioned in
light of the above ongoing consultation.

Next Steps
17. This note is presented to Marine Scotland’s Licensing Operations Team to request a preapplication consultation statement. We request consideration of the evidence of continuous
stakeholder engagement during the development of the project since December 2012 as sufficient
to enable the Marine licence Application to be submitted during March 2015 ahead of a preapplication consultation meeting. The June stakeholder meeting is proposed to complete the precommencement consultation stage. This would enable the scheme to progress as programmed
and funded.
18. Subject to Marine Scotland’s consideration, CH2M HILL will, on behalf of our client, write to
stakeholders, detailed in the Marine Licensing (Pre-application Consultation) (Scotland)
Regulation 2013, informing them of the pending marine licence application in March.
