During the January 8, 2015 Machiasport Planning Board meeting, the Board discussed the need for a Wind Turbine and Communications Tower Ordinance as well as updates to existing Town

Ordinances and Regulations. Below is a list of Town Ordinances and Regulations which was created based on research of Town records. The Planning Board is concerned that they do not have ordinances for certain structures such as wind turbines and communication towers and updated ordinances regarding other matters to guide our work and decisions, then the Board cannot operate effectively. With this in mind, the Board voted to recommend to the Board of

Selectmen the following priorities with respect to creating new and updating existing Town

Ordinances and Regulations.

1.

Create a Wind Turbine and Communications Tower Ordinance. Jim Bradley, CEO, has offered to provide a draft for consideration;

2.

Update the Shoreland Zoning Ordinance;

3.

Update the Subdivision Ordinance; and

4.

Update all other Town Ordinances and Regulations starting with the oldest, until all are updated.

Note: The Planning Board worked for several years to revise and amend the SLZ Ordinance and took the revisions to Town Meeting in 2013. The Ordinance failed to pass. In 2015 the Selectmen appointed an

Ordinance Committee and asked them to review the SLZ Ordinance and Shellfish Conservation

Ordinance. It is not known whether the Ordinance Committee will be assigned to review and revise all other town ordinances.

When installing an outdoor furnace the State Regulations must be followed.

Note:

The Code Enforcement Officer mentioned to the Planning Board on January 8, 2015 that the Town should consider creating an ORDINANCE to cover, regulate and clarify windmills ( turbines) BEFORE a request to install them is considered. The windmill and tower fall zones are cited in the Building Permit, however height requirements of 35 feet only apply to structures located in the SLZ. This may be an urgent need.
