Terms & Conditions of Service
INTRODUCTION
This Agreement is a legal document which is also intended as an informed consent
and guidance for using services provided by Nordic Walking East Kent (also referred
to as NWEK). We have tried to ensure it is written in plain English, but it is
nevertheless lengthy. By booking and/or paying for
classes, packages or memberships, you agree to the terms of the Agreement.
For the purposes of this Agreement,
"We", "Us and "Our" refer to Nordic Walking East Kent (also referred to as NWEK).
"Client", "Clients" "Participant" or "Participants" refer to you.
"Instructor" and "Leader" refer to your accredited instructor or accredited walk
leader.

OUR SERVICE
1.1
NWEK will provide a range of physical conditioning and rehabilitation classes
and courses in accordance with our current timetable. All classes and courses
will either be run by or supervised by a Level 3 Exercise Referral Specialist and
Accredited Nordic Walking Instructor as appropriate to the needs of the class.
1.2
All NWEK instructors and group leaders have been trained to a level
appropriate to their role and been assessed as competent to instruct and/or
lead groups.
2.0
PHYSICAL READINESS OF PARTICIPANTS
2.1
You undertake to provide all relevant information asked for, including that
which will enable us to make an assessment of your fitness needs in relation
to your health and any conditions from which you might be suffering. You also
undertake to alert us to any prescribed medications you may b using and
where necessary, to bring these along on walks to self- administer.
3.0
ELIGIBILITY FOR PARTICIPATION
3.1
All clients are required to complete all four sessions of the "Learn to Nordic
Walk" course before being eligible to take part in regular classes such as
Workout and Adventure Walks. Missed sessions will need to be completed
within another group at your convenience (see paragraph 6.3 below).
3.2
The only exception to this requirement is where a client is able to
demonstrate that s/he has already reached the required level of proficiency,
either by producing an endorsed NWUK or Freedom card or being assessed by
one of our Nordic Walking Instructors (not a Walk Leader).
4.0
BOOKING
4.1
All taster sessions, Learn to Nordic Walk courses and Adventure Walks must
be pre-booked, via our online booking system.
5.0
FEES & PAYMENTS
5.1
Current rates for services are posted on our website.
5.2
All class or session fees must paid in full in advance of the session.
5.3
Learn to Walk sessions may be paid for via Direct Debit, BACS, cash or cheque
(payable to “Erika Lawal”).
5.4
Adventure Walks sessions may be paid for via cash or cheque (payable to
“Erika Lawal”).
6.0
CANCELLATION AND REFUNDS
6.1
If we are forced to cancel a class for any reason, you will not be charged. If
you have a subscription, you will be offered a partial refund or a reduction in
the fee for your next subscription instalment.
Adventure Walks (+ legacy Workout Walks in pre-paid packages)
6.2
Since booking a class or session involves the reservation of space specifically
for you and employing instructors for the session, a minimum of 24 hours
notice is required for cancelling an appointment.
THE FULL FEE WILL NORMALLY BE CHARGED FOR SESSIONS MISSED WITHOUT
SUCH NOTIFICATION – FURTHER BOOKINGS WILL NOT BE POSSIBLE UNTIL
THIS FEE IS PAID.
6.3
Where you cancel a class with more than 24 hours notice, you will not be
charged.
Learn to Nordic Walk courses
6.4
Fees for Learn to Nordic Walk Courses are not refundable, but attendance
course may be deferred if you are unable to attend for any reason. You may
reschedule the missed session to take place with an alternative group at a
time and location convenient for you, subject to space in that new group
being available to accommodate you.
Workout Walk Subscriptions
6.5
Payments once made, are NOT refundable for:
 any client-initiated reason for being unavailable including, but not limited to
vacation, illness, injury, lateness, other responsibilities or demands on your
time.
 public holidays - you may attend any available class later in the week.
 poor weather/travel conditions - you may attend any available class later in
the week.
 second thoughts about a class – please use the PAYG scheme to establish
whether or not a particular class is for you before committing to a
subscription.
 venue or teacher changes – we reserve the right to provide an alternative
venue or cover teacher when necessary.
6.6
Payments and subscriptions are NOT transferable.
7.0
WEATHER
7.1
We operate a "No Bad Weather - Just Bad Clothing" policy. This means we aim
to walk in all weather, providing it is safe to do so and will therefore not
generally cancel a scheduled class due to wet or snowy conditions. If we
decide that it is unsafe to walk, we will contact you, so please make sure we
have up-to-date contact information on file.
8.0
DOGS
8.1
Walking the dog while Nordic Walking is to be encouraged, but not in the
context of a class or session. We therefore do not normally encourage walkers
to bring their dogs along on NWEK walks and request that unless it is a special
event and previously agreed by the group, you leave yours at home.
9.0
PRIVACY & CONFIDENTIALITY
9.1
We will maintain your information however communicated, securely and in
accordance with the laws of England and Wales. NWEK will not release any
records or information it holds about you and your next of kin to any outside
party unless authorized to do so by you, or unless compelled to do so by law
or a valid court order.
10.0 PROFESSIONAL INDEMNITY & PUBLIC LIABILITY
10.1 All NWEK staff hold full professional indemnity and public liability insurance.
