For the purpose of setting forth the terms and conditions of the purchase and ownership by the Buyer/Owner of a purebred

BREEDER/SELLER’s GUARANTEES
All puppies are sold with Limited Registration unless noted above. Puppies that are sold as the show/breeding dogs will
receive their full AKC registration after completing the requirements listed in this contract. Each puppy is purebred and
registered with the American Kennel Club and could be registered in United Kennel Club at owner’s will. The puppy’s AKC
individual registration application will be send to the Buyer when co-ownership fee is made in full, contract is signed and
mailed to the Seller/Breeder. Buyer/Owner has one year from date of issue of AKC or UKC registration application to
register the puppy. The Seller/Breeder and the Buyer/Owner’s names will be listed on pup’s AKC/ UKC/AWSA registrations
as co-owners of the pup. The Buyer/Owner gets 4 generations pedigree and health certificate from a licensed veterinarian.
Each puppy comes with Breeder’s notes of recommendations for the further training and temperament test evaluation results.
a)
As of the date of this agreement, the puppy is in good health and free of communicable diseases. It has been dewormed, vaccinated, examined by a licensed veterinarian, and comes with a veterinarian health certificate.
b) The Buyer/Owner may return puppy (in good condition) to Breeder for a full refund of co-ownership fee for any
reason within 72 hours of purchase, providing Buyer agrees to pay all transportation costs to the Breeder’s address,
if any. After 72 hours the Buyer accepts full responsibility for temperament and physical wellbeing of the purchased
pup/dog.
c)
This puppy sold for Show/Breeding/Performance purposes and guaranteed to be free of any disqualifying fault in
conformation listed in the United Kennel Club White Shepherd Dog breed standard, after the age of 8 months old.
The puppies that the Breeder sells under full contract in Breeder’s opinion have excellent potential for breeding and
performance.
d) The Breeder will actively help with the advice for the life of this puppy/dog. If the puppy mentioned in this contract
will pass her health tests, display a sound temperament and bred to s similar quality stud, the Breeder will provide
help with placing puppies. The Buyer/Owner agrees to raise puppies on her premises and maintain their health and
excellent socialization practice.
HEALTH GUARANTEE:
Note: the Buyer/Owner has to agree to perform OFA x-rays on hips and elbows after the purchased pup turns 24 months old
to qualify for this guarantee. If a pup’s preliminary x-rays have been done by the Breeder before it left the Breeder’s home,
the puppy still must be x-rayed after it turns 24 months old to obtain OFA official certifications to qualify for guarantees on
this contract. The cost for the OFA x-rays and other health tests are equally split between the Owner and the Breeder.
Due to the variety and quality of available dog foods, the Breeder requires that ALL of her puppies be kept on:

A Good Glucosamine Supplement which feeds the cartilage of the joint. We recommend NutriVet Hip/Joint wafers.
Failure to keep your pet on this supplement, or equal quality supplement will render all guarantees null and void.

All our pups are guaranteed against crippling genetic diseases detected within 5 years of age. The Breeder must be notified
immediately and provided with a licensed veterinarian’s report. Any claims must be made within this time period and will be
verified by the Breeder’s own veterinarian. The Breeder needs to have a copy of the x-rays. PLEASE REQUEST FROM
YOUR VET THE X-RAYS IMAGES TO BE SENT TO THE BREEDER.
In case if the puppy has minor faults that are not health related, but disqualify this pup from a breeding program (large
umbilical hernia, ear not erect, un-descended testicle, etc.) the Buyer/Owner will receive the option to purchase another
puppy at a half price. If the purchased dog receives OFA rating less than Fair for hips and Normal elbows, the option of
getting another puppy free of charge will be offered. The Buyer will be required to pay all related shipping costs to get a
replacement puppy and to return the first puppy back to the Seller/Breeder, if the Buyer does not want it. Papers must be sent
to the Breeder with correct transfer signatures. The Buyer may keep the first puppy if he/she chooses to. A copy of a
Spay/Neuter certificate is required before the Seller provides a replacement puppy. NO CASH REFUNDS GIVEN.
If the puppy’ OFA a report comes back with the result of subluxation, the Buyer must repeat the x-rays at a later time at
his/her own expense (at least 6 months after date of original x-ray) before determining that the puppy will not pass
OFA/OVC. No refunds will be given for a report of Panosteoitis (growing pains), as proper feeding can control this and the
puppy should outgrow it.
BUYER/OWNER’S AGREEMENTS
1. The Buyer/Owner agrees that this animal is subject to a AKC non breed agreement until at least 24 months of age, x-rayed
and certified clear of hip and elbow dysplasia by the OFA, is of sound temperament, is in good health and free of
communicable diseases. The cost to lift AKC non-breed agreement is at the Breeder’s expense. It the Buyer/Owner allows
the dog to breed before final OFA x-rays are done this will nullify all guarantees and the Buyer agrees to pay a penalty to the
Breeder/Co-Owner in the sum of $1000.00.
2. The Buyer/Owner agrees that the puppy will reside at the home of the registered Owner, have access to a fenced yard, not
be chained or "tied out", or left alone in a backyard or kennel only and will be provided with proper housing, and exercise.
3. The Buyer/Owner agrees to inform Breeder any time they move or change phone numbers during ownership of the dog.
4. The Buyer/Owner agrees to use name VICTORIOUS at the beginning of dog’s registered name and include the pup’s dam
Call name as a part of pup’s registered name on every registration certificate. Any name or letter that the Buyer chooses may
follow the kennel name. For example: Victorious Wind of Faith (Wind is the pup’s name, Faith is the dam of the pup). We
are proud of our outstanding dams and would like to have their lineage easily recognizable in their progeny’ pedigrees.
5. The Buyer/Owner agrees to register co-ownership of the puppy with AKC within 1 month of receiving the form and to
send a photocopy of the certificate to the Breeder to qualify for the guarantees on this contract.
6. The Buyer/Owner agrees not to sell, trade, lease out, euthanize (except under emergency conditions to end suffering), or
give away the dog without verbal, or written permission from the Breeder.
7. If for ANY reason the Buyer/Owner can no longer keep the puppy he/she MUST notify the Breeder immediately. Breeder
and the Buyer/Owner will work together to find an acceptable new home for the puppy. If an acceptable home cannot be
found the Breeder will take responsibility of the puppy. The Buyer/Owner understands that in such case he/she must to return
the dog with signed AKC registration transfer to the Breeder/Seller without receiving any refund. The Buyer/Owner will
handle shipping arrangements and expenses, if any. Under no circumstances may this dog be disposed of or surrendered
to a Dog Pound, Humane Society, Animal Shelter, any Rescue Organizations, Pet Store, other Breeders, or to
individuals associated with a suspected or proven puppy mill.
8. The Buyer/Owner agrees to comply with all local ordinances regarding the keeping of dogs, in addition to providing
adequate food, water, housing, immunizations and health care, and humane treatment for the dog.
9. The Buyer/Owner agrees to actively train this puppy in dog sports that the Buyer might see this dog fit. The Buyer/Owner
agrees to show this dog in UKC conformation shows and complete this dog’s Championship. The cost for the classes, shows
and trials is a full responsibility of the Buyer/Owner.
10. The Buyer/Owner agrees to maintain this dog in good health, provide routine preventative health care including, but not
limited to, inoculation, internal and external parasites, and - where suggested by a vet - heartworm preventative medication.
All expenses regarding the animals including: shipping of the animals, proper care, veterinary fees, housing, or legal
liabilities are the responsibility of the Buyer/Owner at whose home the animal will reside. The Breeder will pay for lifting of
a non-breeding contract after this dog passes OFA hips and elbows.
12. The Buyer/Owner agrees to keep this dog properly nourished (HIGH QUALITY FOOD) and exercised (NO JUMPING
OUT OF TRUCKS, CHASING A BALL, CATCHING FIRSBEES, OR JOGGING etc. before 1 year of age). The dog must
be kept lean and not over weight.
LIMITATION OF THE CONTRACT
1. If the pup/dog is used heavily for agility, open obedience, or any other strenuous activity including road working, quad
working or forced jogging by treadmills or the opposite extreme and is restricted to a travel crate for prolonged extended
routine periods of time without easy regular exercise resulting in underdeveloped muscle tone prior to being 12 months of
age, environmentally induced hip or elbow dysplasia and other joint problems may develop. If these factors are factors in
diagnoses, it is left to the breeder's discretion to honor this agreement. The Seller/Breeder may reserve the right for the
prompt return of said dog.
2. This Contract applies to the original Buyer/Owner only and not transferable to a second party. The Breeder must receive
signed contract within 30 days of receipt of dog or it will be considered invalid.
3. Please note: the Breeder does not guarantee that pup’s coat will stay pure white, nor that the dark nose pigment will not
fade, as some pups develop some cream in their coat, or the nose may lighten as they mature, which is perfectly normal and
does not affect the health of the puppy. The Breeder does not guarantee that the pup will win at the conformation shows, or
performance trials.
4. This guarantee does not cover common Giardia, Coccidia, or other intestinal parasites that puppies frequently pick up.
If Breeder/Co-owner can document the Buyer/Owner’s failure to keep these agreements and so informs Buyer/Co-owner by
certified letter, the buyer shall have 72 hours to return the dog and the signed AKC registration transfer to the seller at his
own expense. If the Buyer/Owner fails to do so, the seller shall have the legal right to repossess the dog and get a signed
AKC registration transfer application from the Buyer/Owner without refunding any money. In addition, the Buyer/Owner
shall be liable for any expenses incurred in the process of repossession (including attorney’s fees and court costs), and
veterinary expenses to restore the dog to good health, if necessary. If it is not possible for the buyer to return the dog and
AKC registration transfer, the Breeder/Co-owner will recover the greater sum of $1,500, or the purchase price of the dog, as
damages for breach of this contract. The parties to this contract agree to submit to the jurisdiction of the Erie County of the
New York State for any dispute arising out of this contract.
Both, the Breeder/Seller and the Buyer/Owner have read and agree to the above conditions.
