I have read and understand the Sale of Recycled Metals Act, NMSA 1978 57-30-1 to -14, and the requirements
listed on this page is not an exhaustive list. It is my responsibility to comply with all requirements of the Act
and ensure that my employees comply with the Act.
I have read and understand the New Mexico Regulation and Licensing Department Rules, NMAC 12.2.15 to
.18.
I understand a secondhand metal dealer shall not buy or sell regulated material without a valid registration
issued by the department and that I am responsible for renewing the certification prior to the three-year
expiration, in compliance with NMSA 1978 57-30-2.1 to 2.2.
I affirm that I am in compliance with all federal requirements for scrap metal dealers, including maintaining
storm water permits as required by NMSA 1978 57-30-2.3(A)(2).
I have registered with the metal theft alert system at www.scraptheftalert.com and will keep all employees
apprised of alerts, in compliance with NMSA 1978 57-30-2.3(A)(3) and (A)(4).
I understand stolen or unlawfully obtained regulated materials shall not be removed from the dealer’s premises
and shall be reported to the local law enforcement agency with 24 hours under NMSA 1978 57-30-2.3(B).
I understand no restricted transactions shall be made without written documentation that the seller is the
rightful owner or has permission from the rightful owner to prove the material was lawfully obtained, in
compliance with NMSA 1978 57-30-2.4(A).
I understand that I must post a notice regarding regulated material in a prominent place per NMSA 1978 57-303.
I understand nearly all purchases under NMSA 1978 57-30-5(A) require the seller’s information to be recorded
along with the purchase, and such documentation must include all information listed under NMSA 1978 57-305(B).
I understand each record shall be preserved for one year at the dealer’s place of business, from the date the
record was made as set forth in NMSA 1978 57-30-6 and must be produced to a peace officer upon request as
set forth in NMSA 1978 57-30-7(A).
I understand that all transactions of regulated material must be reported and uploaded to the database within the
second business day after the purchase date as required by NMSA 1978 57-30-8.

Once received and approved by the Department, you should expect your certification to be mailed
to your attention at the business address listed on the application, unless otherwise noted. The
certificate must be posted in the business of operation in a conspicuous place. If you have multiple
locations, the original certificate must be posted at your primary location and certified copies
furnished by the Department must be posted at each of your other locations. Your certification will
be valid for three years from the date of issuance, unless the registration is suspended or revoked.
Prior to the expiration of the certification, all registered secondhand metal dealers shall apply for
registration renewal and shall pay the renewal fee.
