STATEMENT OF DECISION
The Management of the Westminster Freedom Pass Applications Processing
Service by the Royal Borough of Kensington and Chelsea
Notice is hereby given that Councillor Rachael Robathan, Cabinet Member for Adults
& Public Health has made the following executive Decision on the above mentioned
subject for the reasons set out below.
Summary of Decision
1.
That the report be exempt from disclosure by virtue of the Local Government
Act 1972, Schedule 12A, Part 1, paragraphs 2, 3 and 5, in that it contains
information which is likely to reveal the identity of an individual, information
relating to the financial or business affairs of any particular person (including
the authority holding that information), and information in respect of which a
claim to legal professional privilege could be maintained in legal proceedings.
2.
That approval is given to extend the section 113 Local Government Act 1972
agreement for Adults Social Care between the Westminster City Council, the
Royal Borough of Kensington and Chelsea and the London Borough of
Hammersmith and Fulham, in order to include the delivery of the applications
process for Westminster City Council’s Freedom Pass service to the Customer
Access Team within the Royal borough of Kensington and Chelsea.
3.
To note that under the Transfer of Undertakings Protection of Employment
(TUPE) rules, one person currently employed by Amey will be TUPE
transferred to Westminster City Council and will move from their current
location to the Customer Access Team provided by the Royal Borough of
Kensington and Chelsea
Reasons for Decision
1.
A successful Transport service is currently being delivered via the Customer
Access Team in the Royal Borough of Kensington and Chelsea and this team
is beginning the process of delivering delegated transport services on behalf of
the other two boroughs as part of Tri-borough arrangements.
2.
The contract between Westminster City Council and Serco ended on the 25th
April 2014.
3.
Freedom Pass applications need to be processed as part of the transport
provision offered by the Westminster City Council.
4.
There is one person employed by Amey that qualified under the Transfer of
Undertakings Protection of Employment rules.
5.
The transfer of the Westminster City Council Freedom Pass service to the
Customer Access Team presents the Royal Borough of Kensington and
Chelsea with an opportunity to innovate, develop and deliver an efficient Triborough approach to the way transport services are delivered across the three
boroughs. This would also include an opportunity for efficiencies to be made.
