a. Review of meeting notes
Discussion/Agreed-Upon Actions
The meeting began at 9:15.
The Chairman welcomed the committee and stated that they
would table the review of the meeting notes until the next
meeting as there was not yet a quorum present.
II. Military Installation Overlay Zone
a. Review of draft legislation
The Chairman commented on staff’s proposed approach to
the MIOZ legislation (which followed) and feels that the
draft is nearing completion. He stated that he feels this may
be a game changer for Joint Base Andrews but that it will be
widely accepted by the Administration.
Staff provided an overview of the issues leading to the
narrower focus and scope of the MIOZ.
Staff provided the committee with the first draft of the
proposed legislation and pointed out some of the changes
and deletions from the ILUC bill and where new language
was added. Staff is still looking for input from the
Development Review staff and from the attorneys. A map
and language will also need to be added to address the JBA
Microwave Communications Corridor. Permit/development
application notification language to JBA will also be added.
There was discussion about achieving a balance between
being too aggressive and too relaxed with the regulations.
There is not a clear place to draw the line, especially with
regard to the Clear Zone.
Much of the discussion focused on the Prohibited Use list.
The committee agreed that eating and drinking
establishments within the APZ 1 & 2 zones would be no
larger than 3,500 square feet and those in the DDOZ would
be exempt, allowing them to remain at a maximum 6,000
square feet. No eating and drinking establishments will be
permitted in the Clear Zone.
Col. Hartman cautioned the committee on being too lenient
on restrictions within the MIOZ and expressed his concerns
regarding some of the permitted uses within the Clear Zone.
Mr. Calvin Grigsby commented that the FAA has had
similar issues with MIOZ’s in other areas and has a lot of
information on regulatory takings and transfer of
development rights. He also suggested that the committee
look to the Department of Housing and Urban Development
for ways to obtain Clear Zone properties, and further
suggested inverse condemnation.
The Committee Chair indicated that staff could commence
public outreach with the draft legislation.
III. Subcommittee on Economic
Development-update
The subcommittee reported that they are recommending
concurrent legislation to offer a full or partial tax credit for
attenuation to existing residential properties located in the
High Noise contour. At the next meeting (October 18th) they
will also look at other economic development tools and
approaches for mitigation.
IV. JBA Survey update
Stephen Harrington reported that the survey cannot be
distributed through the JBA survey office as originally
anticipated, due to a DOD policy issue. Col Hartman stated
he will continue to work with Stephen and Mr. Estepp to
move this effort forward. Staff indicated they may be able to
assist with the design of the survey. Col Hartmann
suggested that marketing will be important, so people are
aware of the survey. Per suggestions from the committee,
Stephen indicated that he would look into using the
M-NCPPC website to host the survey. While EDC will not
be able to help they will be in the loop.
V. Public Participation (15 min)
There was no public participation.
VI. Information Sharing
Staff mentioned that the RFP is out for the OEA Grant
consultant and that they should be selected by November 22.
Ms. Johnson introduced Jordan Thomas of the County
Executive office who will be leaving to go into the Air
Force. She also informed the committee that Rev. Ty
Blackwell of Forest Memorial United Methodist Church on
Forestville Road offered to host the public meetings. The
chair concluded her comments by suggesting Tom Aylward
would be of assistance in setting up future meetings with
segments of the religious community.
Mr. Estepp mentioned that the County would like to take
over the public charter schools and take the lottery away
from Imagine Andrews. The JBA school conducts their own
lottery which is more complicated as it has two waiting lists
for students both on and off base. He asked that the
committee reach out to their contacts to discourage this idea.
