STUDENTS TRANSFERRING INTO DISTRICT 200 WITH AN

ACTIVE IEP FROM THE PREVIOUS DISTRICT

It is the goal of District 200 to minimize any interruption of special education services when students with disabilities transfer into the district with an active IEP. Requirements under IDEA are designed to avoid a disruption in service for transfer students. Upon enrollment, the child study support technicians (CSSTs), during the school year and special services office, during summer months, will take prompt action to secure the student’s special education records from the previous school, including the most recent evaluation summary report (ESR), individual education plan (IEP), and any other supporting special education documents.

When a student with a disability and an active IEP moves to District 200 from another school district, the special education team will:

Consult with the student’s parent/guardian and document the consultation in the communication log on iPlan. Since this is a continuation of existing services, a prior written notice (PWN) and the 14-day calendar waiting period is not applicable.

Provide special education services comparable to those described in the previous

IEP until:

1) A new evaluation, if determined by the team to be necessary, is completed.

Possible reasons for determining a new evaluation is needed are:

The student transferred from out-of-state and a review of the most recent evaluation does not present evidence that the student would meet

Minnesota eligibility requirements

The previous evaluation is three or more years old

The student’s needs appear to exceed those identified in the previous evaluation

The student is now at the age/grade where a transition assessment is required

For Specific Learning Disability only:

 If the previous evaluation from another Minnesota school indicates that the student met eligibility criteria for SLD under an SRBI model (RtI), the student will be eligible for services in District 200 until the next three- year evaluation.

If the student transferred from another state to District 200, and available data indicates that the student would meet criteria for SLD under an SRBI

Model, the student will be eligible for services in District 200 until the next three-year evaluation. Otherwise, an initial evaluation to determine eligibility must be conducted as soon as possible.

2) A new IEP is developed.

Note: Both number 1 and 2 above require a PWN, with a parent/guardian signature, as an initial evaluation/IEP in District 200.
