The Chairman welcomed the Council and wished them a Happy New Year and a productive one within the
Community Council. He then introduced and welcomed Moray Council Convenor, Mr. George McIntyre.
MINUTE OF MEETING of 10th December 2008

1.0 BUSINESS ARISING FROM PREVIOUS MINUTE.
1.1 Councillor Hogg gave and update on all outstanding works and was thanked for the work he
has done on the Community Council’s behalf.
1.2 Duffus Bus stop – No money available for more suitable one.
1.3 Lossiemouth to Duffus Cycle path – temporary halt in place until further funding is available.
1.4 Dog Fouling Bins. Site visit to be arranged.
1.5 Tree roots on the Birnie road noted and road being surveyed.
1.6 Litter bins are being provided at requested areas.
1.7 Findrassie road is on the reserve list of works to be done.
2.0 CORRESPONDENCE
2.1 Gypsy/Traveller Awareness Raising Sessions – reply sent that we will attend. 24.4.09
2.2 Climate change and National Forest Estate – consultation paper being completed.
2.3 Letter from Scottish Parliament on lease of 25%of Scottish Forestry, noted.
2.4 Scottish Parliament research brief on Village Halls circulated for comment.
2.5 Removal of condition 3 of Planning consent 08/02488/Ful noted.
2.6 Scottish Government Community Council Consultation – finding read out.
2.7 National Planning Framework and Mr. Kennedy’s comments noted.
2.8 Invitation to ASCC meeting with MSP’s Question Time 21.3.09 Laichmoray Hotel.
Chairman and Secretary to attend, others encouraged to do so.
2.9 ASCC election of representative – Les Morgan willing to continue
2.10 JCC meeting 12th February – paperwork available on request.
2.11 Scottish Parliament results on Climate Change questionnaire completed in December and
noted.
2.12 Scottish Parliament consultation of Bus Services Bill circulated for comment.
3.0 ANY OTHER BUSINESS
3.1 Wind farm applications sent to Norway on 1st December from Castle Douglas
3.2 Speeding noted on the Bank Road at Roseisle. Councillor Hogg to ask for ‘Archer check’.
3.3 Hedges and verges require trimming on the Dallas road near Edinvale. Councillor Hogg to
ask about that.
3.4 There is a broken tree branch on the roadside at Torrieston walks and also at Manbeen farm
entrance. Secretary to alert Forestry Commission and Roads dept.
3.5 Some of the residents in Alves have difficulty keeping the flimsy kerb side recycling bins on.
Councillor Hogg to look into this.
3.6 The recycling can bins have openings which are too stiff to use. It is felt that ragged edges
could be a Health and Safety hazard. Secretary to write about this.
3.7 Spynie has insufficient paper recycling bin capacity for the area. Secretary to write about this.
3.8 Convenor – Mr. G McIntyre said he had enjoyed meeting Heldon Community Councillors
and valued the opportunity to see what happens at the ‘grass roots’. He noted that the issues
were similar to those of his own area of Lennox.
4.0 PLANNING APPLICATIONS
4.1 Full planning application for change of use and extension to convert Maltings office to
dwelling house at Coleburn Distillery. No objection.
4.2 Full planning application to erect a 5kw domestic turbine at Coneloch, Birnie. No objection.
4.3 Full planning application to modify existing planning permission reference 07/02674/Ful
Adjustment of access route to dwelling house at yard behind Pluscarden Hall, Pluscarden.
Objection sent.
4.4 Full planning application of re-orientation of approved house and agricultural building at
Rosebrae Farm, Clackmarras. No objection.
4.5 Full planning application to erect revised house design on amended location at Mid Torehead,
Pluscarden. No objection.
4.6 Full planning application to erect two dwelling `houses adjacent to Wester Oldtown, Roseisle.
No objection.
4.7 Full planning application to erect 435 units comprising houses and flats with associated road
network at Spynie. Further information requested.
4.8 Full planning application to erect new dwelling house adjacent to Whitehill, Brodieshill,
Forres. No objection.
5.0 TREASURERS REPORT read out.
