“You are grounded in federal and state case law permitting
school searches when (1) there is individualized suspicion that a
student is breaking a law or school rule or (2) a safety concern
that overrides the individual student’s expectation of privacy.
State v. Gage R. 149 N.M. 14, 243 P.3d 453 (Ct. App. 2010).
School officials would have individualized suspicion if a student
brought a cell phone into the test arena, so long as the school
announces clearly that bringing the electronic device into the
testing arena constitutes a violation of this policy AND a
violation of this policy is grounds for a search of the device.”

Search Permitted if:
•
School has clearly stated
1) NO ELECTRONIC DEVICES DURING TESTING and
2) VIOLATION RESULTS IN CONFISCATION AND SEARCH
OF DEVICE.

Student is caught with device during testing.

Staff should not leave test

Materials Chain of Custody
Count each booklet every time
it changes location
Sign in/out all materials
Check sheets should indicate
movement of materials for extended
time, make-ups, accommodations, etc.
Immediately report missing materials
to STC, DTC, and PED

Testing Irregularity
Any circumstance within or beyond the
control of a school district that in the opinion
of the PED or a school district, raises doubts
about the propriety of standardized testing
procedures, preparation of materials,
standardized test administration, standardized
testing security, student scores attained from
standardized testing, or teacher or student
conduct observed during standardized testing.

If a testing irregularity occurs:
1. TA reports to STC
2. STC reports to DTC
3. DTC and STC conduct
internal investigation
4. DTC fills out Testing
