RE: NOTICE FOR TERMINATION OF CONTRACT OF SERVICE: Z(NAME OF CLIENT)- (POSITION IN THE
AFORESAID COMPANY)
We have been retained by the above mentioned client and duly instructed to you and which we hereby
do as hereunder:
1. That the named employee was served with what was “purported” to be A NOTICE FOR THE
TERMINATION OF CONTRACT OF SERVICE dated…………………..
2. Whereas the notice stated that the affected employees were issued with a one month notice,it
also went ahead to inform the employees that their last day at work was…………….
3. We do hereby bring to your attention that the purported notice doesn’t constitute to a legal
employment termination notice as envisaged under the provisions of law under Employment
Act 2007
TAKE NOTE that your purported NOTICE OF TERMINATION OF CONTRACT is not only illegal and unprocedural but also unconstitutional. It contradicts all the provisions of law envisaged in Labour laws
of Kenya, constitution that is the supreme law of the Land and even all International Labour
Conventions ratified by Kenya.
OUR FURTHER INSTRUCTIONS are to inform you to restrain from such illegality and be informed that
the Kenyan Labour Laws and ILO recognized and ratified conventions provide for clear instructions
for termination and lay-off of employees contract of service. Employees must be informed of their
final dues including severance allowance, salary in lieu of notice and all outstanding allowances
together with all monies duly owed to them that must be paid.
TAKE FURTHER NOTICE that failure to withdraw and cease from the illegal venture within 7 days
then client will vigorously and effectively contest in the courts of law through the laid down
provisions. And it shall be at your own peril as to costs and other incidental issues arisingthereto.
