Adversarial trial system
- Procedure where contestants seek to establish throught the relevant supporting
evidence, before an impartial trier of facts or happenings which form the bases of their
allegations
o This is not a scientific inquiry
 Leave it up to the parties on what investigations and evidence to bring
forward
 The defendant and plaintiff have the greatest interest/ability to bring
forward relevant information
o Decision is based on this information alone
o Judge is a neutral arbiter
o Distinguished from the inquisitorial system used in the U.S
