UPON the Claimant’s claim commenced by Claim form herein dated 29 June 2018 (the “Action”)
AND UPON the Defendants’ application dated 17 December 2018 pursuant to CPR 13.2 and/or
13.3 and the Claimants’ application dated 20 March 2019 pursuant to CPR 6.15(2) and CPR 6.27
(the “Applications”)
AND UPON the Judgment of Deputy Master Bowles handed down on 12 December 2019

AND UPON hearing Denise McFarland, Counsel for the Defendants and Bridget Lucas QC,
Counsel for the Claimants
AND UPON reading the skeleton arguments lodged on behalf of each party and the documents
relevant to the Applications and Action recorded on the Court File
IT IS ORDERED THAT:
1.
The Claimants shall pay the Defendants’ costs of and occasioned by the Applications and
Action as set out below, to be subject to detailed assessment on the standard basis if not
agreed:
a. 90% of the Defendants’ costs of and occasioned by the Applications; and
b. Subject to paragraph 1(a) above, the Defendants’ costs of and occasioned by the
Action;
2.
The Claimants shall make an interim payment of £90,000 on account of costs by 5pm on 4
February 2020.
3.
The Parties to have liberty to apply.
SERVICE OF THIS ORDER
This Order shall be served by the Defendants on the Claimants.
