GENERAL TENDER TERMS, CONDITIONS & ELIGIBILITY CRITERIA

General Terms & Conditions, Eligibility Criteria
The tender is required to be submitted in Two bid systems: (i) Technical Bid and (ii) Financial
Bid. The envelope (1st) of Technical Bid shall contain DD of Tender Form Cost of Rs. 525/(Five Hundred Twenty Five only) Non-Refundable including VAT@5% and Second No. of
DD/Banker’s Cheque/FDR as EMD of amount of Multiplication of Rs.5000/- X Nos. of Sub
Groups for which Tenderer want to be participate (Details must fill in the Proforma-I),
Qualification Criteria, Original broucher, Technical Specifications of the Essential Office
Appliances for which firm/bidder/agency has applied in 1st sealed envelope and Financial Bid
in the Second sealed envelope duly sealed and signed by the Bidder. The Bidder who does
not fulfill above mentioned requirements, their Bid shall not be considered for Tender
Evaluation.

Checklist enclosed to tender documents must be prepared & submitted in the prescribed
manner along with the Technical part of the Bid document within the given time.
3.
The tender offers must be submitted by the Manufacturer or their Authorized dealer
having Authorization certificate. A self attested copy of Certificate should be enclosed for
ready reference as per Performa-I of Annexure A.
Compliance of Specification on Letter head is mandatory from Manufacturer / Local
Branch office, Service Center & warehouse of OEM is required for fast
service/replacement ( Details must be accompanied)
EMD Amount would have in the form of Banker’s Cheque/DD(Non Interest
Bearing) of Multiplication of Rs 5000/- X Nos. of Sub-Groups for which Tenderer
want to be participate is to be drawn in favour of “Director AIIMS Bhopal”. In
respect of successful bidder it will be returned after deposit of @5% of
Order Value as Security Deposit (SD) in favour of “Director, AIIMS Bhopal”
by the way of DD/Banker’s Cheque (Non interest bearing)/FDR and be
refundable after the expiry of Warranty period which will commence w.e.f.
the date of successful installation of items at AIIMS Bhopal. Any other dues
outstanding shall also be recovered from the SD.

The tenderer, who has failed to submitted the EMD Amount as specified in above mentioned
point no. 4 of General Terms & Conditions along with their Technical Bid, shall declared
Technically disqualify and accordingly on the basis of the same their financial bid will not be
opened in any circumstances.

The quoted rates shall be inclusive of excise / custom duty (if applicable), packing &
forwarding, freight, transit insurance, installation, warranty, training, maintenance support
during warranty period, accessories required for installation and but exclusive of commercial
tax other levies / local taxes as/if applicable (mentioned separately in price bid).

In case opening date of tender is declared as holiday, the same shall stand extended to the
next working day automatically.

The Tenderer must enclose the legible Copies of Incorporation Certificate/Registration
Certificate, Authorization Certificate from Manufacturer Company, Firm Status like
proprietary/partnership firm, Memorandum of Articles and affidavit for non-black listing for
last 5 years with Technical Bid for Technical Evaluation.
Technical compliance statement must be submitted for the Annexure ‘A’ along with the
certificate of stating quoted equipment is 100% complied with all technicality and
Certifications like NABL (National Accreditation Board for Testing and Calibration
Laboratories for Chemical/Biological Testing for Water Purifiers/Coolers and BEE (Bureau of
Energy
Efficiency)
Compliance/Strar
Rating/Safety
Certificates
for
Power
rating/saving/Safety as per the Guidelines of MNRE for Microwaves, Heat Convectors,
Refrigerators as asked in Annexure ‘B’ (i.e. technical specifications).

It will also be the responsibility of the tenderer to inform and pass on the benefits due to
Statutory/ Budgetary reduction in Excise and Custom duty, immediately after its publication in
the Gazette, else their Security Deposit shall be forfeited and action for black listing the
Vendor/Company may also be taken.

The terms & conditions given by the supplier will not be binding to AIIMS Bhopal. Conditional
tenders shall be rejected at the sole discretion of the competent authority of the AIIMS
Bhopal.

The Bidder must provide the list of their own Service Centers in as well as a separate list of
Franchise/authorized service Centers along with the detail of their Phone/Cell-phone/Fax/email Ids and name of the Contact person(s) etc. The bidder should have local service
infra structure (i.e. in Bhopal City).

Bidder has to submit copy of the Sales Tax clearance certificate, copy of TIN/TAN No., PAN
Card No. Service TAX Nos., MPVAT, etc. List of Users must be attached with technical Bid
without this bid will not be considered.

Firms black-listed by any of the department of Central/State Govt. need not to participate in
this tender.

Warranty (36 Months with Spares and Labour etc.) :The items requested with this Tender
should have at least Three year onsite Warranty including all spare parts and labour against
any defect with effect from the date of delivery. The Tenderer should replace the defective or
substandard material within one week time from the site of AIIMS Bhopal on receiving written
intimation. If Tenderer fails to replace the defective or substandard material/equipment from
the site within a week time, Penalty @1/2% per week of the cost of such substandard
equipment may be deducted from Suppliers pending bills or from Performance Security,
which ever available with AIIMS Bhopal subject to maximum of 3%. Offer without warranty
of products shall not qualify for opening of Financial Bid.
Tenderer should give guarantee for availability of spare parts and consumables for a period
of minimum five years from the date of completion of Warranty of 36 Months.

upgraded model details, immediately as soon as it is launched before execution of the given
order if there is any change in asked specification in PO.

Demonstration: The Tenderer are required to demonstrate the Equipment after supply to the
nominated technical committee before processing the bills payment of the supply.

Terms and conditions of repair and maintenance contract (after expiry of warranty/guaranty
period) should be provided separately.

The Rate contract shall be for a period of one year from the date of award of contract
or as indicated in the Letter of Award (LoA)/Purchase cum Supply Order. The
contract may be extended year to year basis subject to a maximum period of 1 year),
on the same terms and conditions or as may be agreed mutually by both the parties
under the prevailing circumstances.

The tendering Firm/Agency/Company are advised in their own interest to quote their
rates for their preferred/specialized items (i.e. Microwave Oven, Heat Convector,
Refrigerator, Water Purifier, Water Coolers etc as per the specifications indicated in
the Financial Bid in separate sealed and signed envelope failing which their bids shall
be out rightly rejected. Client have right to accept and reject any bid without
mentioning any reason.
Minimum Technical Eligibility Criteria For prospective Tenderers:-

Bidders should submit valid ISO/BIS Certificates (True copies).
b)
The Bidders should have a NABL (National Accreditation Board for Testing and
Calibration Laboratories for Chemical/Biological Testing for Water
Purifiers/Coolers and BEE Compliance/Strar Rating/Safety Certificates for
Power rating/saving/Safety as per the Guidelines of MNRE for Microwaves, Heat
Convectors, Refrigerators and a copy of the same must enclose with Technical
Bid document for Technical Evaluation.
c)
Bidders should have minimum experience of total 3 completed supply orders
of similar nature appliances for each Sub-Group wise supply in Government
Organizations, Semi Government Organizations, PSU’s related Organization
during the last 5 Years and duly certified documentary evidence of the same
has to be produced by the concerned respective authorities, which should be
either of the following:Should have satisfactorily executed the supply of Similar nature items to
reputed Institutes/Govt. Offices/PSUs for each Subgroup wise for which the
Tenderer is interested to participate in this Tender. He must enclose the copies of
previous Purchase Orders for each sub-group wise for the value as follows for
Technical Evaluation :

Accountant/Company Secretary indicating the Financial Turnover and Profit &
Loss Account must accompany with Technical Bid.

Bidder should produce Income tax returns & Balance sheets for the Past three
years ending 31st March 2013 along with copy of PAN/TAN No. Sales Tax
registration Certificate.

For the purpose of Technical Evaluation of the Electrical appliances, AIIMS
Bhopal having the right to direct the participating Bidders for display their quoted
product at AIIMS Bhopal. The bidder shall bear all cost and expenditure incurred
and/ or to be incurred in connection with tender including preparation mailing
and submission of tender and for subsequent processing, organizing the mockup
sample display of the Items for mockup show/presentation at AIIMS Bhopal. The
purchaser will, in no case be responsible or liable for any such cost, expenditure
etc regardless of the conduct or outcome of the tendering process.

AIIMS Bhopal reserves the full rights to increase/decrease the quantity of items in the
tender as per its actual requirement during the concurrency of this Rate Contract.

EMD Amount in the Multiple of Rs. 5000/- x Nos of Sub-Groups for which the
Tenderer want to participate should be submitted in the form of Demand
Draft/Banker’s Cheque/ FDR, from any Nationalized scheduled Bank in favour of
“Director, AIIMS Bhopal”.
EMD should be submitted in the Technical Bid
envelope along with Technical Bid Documents. Please note that the no interest is
paid for EMD Amount deposited by any Tenderer by the AIIMS Bhopal.
i.
Non-responsive tender/offer the earnest-money (EMD) will be refunded to the
tenderer in due course of time without any additional interest amount. The
earnest-money (EMD) of successful Tenderer will be refunded after receiving
of 5% Value of Purchase Order as Security Deposit by the way of DD/Banker’s
Cheque(Non-interest bearing)/FDR in Favour of “Director, AIIMS Bhopal”.
ii.
The entire amount of Earnest-money Deposit will be forfeited in case the
Supplier either expresses his inability or does not execute the order after the

award of work and Security Deposit shall be forfeited in case if the successful
vendor fail for the maintenance of the supplied items to AIIMS Bhopal within
the Warranty Period (including spare parts and labour etc.) with him within the
validity period of tender at the rates quoted in the tender.
6.
Trade/Sales tax or any other tax or other charges on the material, which has not
been mentioned while quoting their rates, shall not be paid by the AIIMS Bhopal
under any circumstances.
7.
If during the currency of the contract, the prices (s) of the contracted stores falls,
the supplier shall have a binding to charge the prevailing lower rates against the
higher contracted price. However, the purchaser is not liable to compensate the
supplier any hike in contracted price during the contract period.
8.
Payment:
a) On successful installations and commissioning of the Electrical appliances as per
“Annexure-B”, the supplier shall obtain a Final Acceptance Certificate (FAC) from the
concerned user Department. Based on FAC supplier shall submit 100% Bill in triplicate
along with following documents to the user department:(i) Packing List
(ii) Delivery Challan
(iii) Test Certificate(s)
(iv) Consignees Copy of Transport Receipt
(v) Excise Duty Gate Pass (if Excise Duty is separately claimed in the bill).
(vi) Guarantee / Warrantee Card with Local Service Centre Contact Details.
(vii) Operation / Maintenance Manual
(viii) Final Acceptance Certificate (FAC) from the User Department.
b) On receipt of Bill along with above documents, the User Department shall verify the
Bill and forward to the Central Stores Department along-with issue Indent.
c) The Central Stores Department shall account for the receipt and issue of appliances in
Central Store Ledger and record pass order and transmit the same onward for
payment within a reasonable time.
d) Applicable Taxes will be deducted from the Bills of the Bidders as per Govt.
existing rules in force for the time being.

The prices should clearly indicate actual cost of item. The taxes, duties etc should
