• Doug Fabick, Dealer Principal of John Fabick Tractor Company
(Fabick Cat®), Fenton, St. Louis County, MO, and Jeré Fabick,
Dealer Prinicipal of FABCO Equipment Inc., of Milwaukee,
WI, successfully finalized combining their two family-owned,
independently-operated companies on July 1, 2015. Bringing the
two Cat dealerships together continues a shared heritage that
dates back to 1917 when John Fabick Sr. founded the first

Up-To-Date and Effective? He
provided a slide presentation and
handouts on the topic.
At the April 24, 2015 meeting
Katie D. Triska, of the Reinhart
Boerner Van Deuren s.c. law firm
spoke on the topic “Legal Pitfalls
to Avoid When Dealing with Your
Employees.” She distributed a
handout entitled “Eleven Tips to
Minimize Employment Liability.” Her topic
included employee handbooks, internal
investigations, termination decisions,
employee/independent contractor, and drug and
alcohol testing.
His presentation included whether a handbook is
right for your business, pros and cons of certain
handbook provisions, and legal pitfalls. He spoke
on employment discrimination, retaliation claims,
breach of contract, defamation, wrongful
discharge, union contract “just cause” provisions,
and employment at will. In addition, such
subtopics as what can a handbook do for me,
disadvantages of a handbook, a handbook as a
binding contract, and disclaimer language. Finally,
Mr. Bartel spoke on a Report of the General
Counsel Concerning Employer Rules dated
March 18, 2015.

topic of the New Federal
Confined Space Standard
that takes effect August 3, 2015.
On that same date,
Patrick Kelly, First
Hand Safety, LLC
spoke on the topic of
Heavy Equipment
Safety.
Mr. Kelly stated the following: “Buckets and
blades must be chained down at four locations;
some ratchet and lever-type tie downs are
dangerous; explained the importance of trailer
flagging; annual inspections; the importance of
quality chains; tagging of tie-down chains
relative to ratings; and more.” He also stated
that not all trailers are alike relative to hauling
of heavy equipment and it is dangerous to load
and unload equipment. He suggested to call
the local sheriff to block off the road to ensure
safe loading or unloading of heavy equipment
from a trailer. Use a spotter when loading and
go slow. Load on flat ground. Pay attention to
trailer weight restrictions. Some people haul
14,000 pounds of heavy equipment with a
trailer hitch rated at 5,000 pounds. Do not
forget to wear your seatbelt when loading or
unloading heavy equipment.
OSHA is postponing full enforcement of the new
standard to October 2, 2015 in response to
requests for additional time to train and acquire
equipment necessary to comply with the new
standard.
Mr. Lutz also provided a slide presentation on the

Hazards; What Employers are Responsible For:

Pipe to include the proper face mask and breathing apparatus.” The program included a hands-on

Upcoming WUCA 2016 Midwinter Conference
Please Register Early
The Wisconsin Underground Contractors Association (WUCA) scheduled its upcoming 2016 Midwinter
Conference for the beautiful and family-oriented Atlantis, Paradise Island Resort and Casino Nassau in the
Bahamas. Please mark your calendars and plan on attending during the dates February 24-28, 2016.
The average high temperature during our February visit is 78-degrees. Because this is a foreign country yet
approved by the IRS for business travel, passports are required. You can view the property at

Our tentative program includes an opening reception, breakfast coupons each day, educational seminars, and
an outdoor group meal to include live entertainment. We will also have an optional 60-minute boat cruise and
optional 2-hour bus island tour. The island’s golf course is about a 5-minute drive and the resort provides a
free shuttle.
Delegates that wish to arrive early or stay longer can do so as our room rates apply three days prior and three
days after our conference dates. As in the past we will also have quality educational sessions that are geared to
meet your needs.

of Public Works Herbert A. Goetsch
died June 8, 2015 at age 96. He
served as commissioner between
the years 1963-1988. In retirement,
he would visit the WUCA office
from time to time and always

WUCA’S Dick Wanta Set to Retire
Wisconsin Underground Contractors Association executive director
Dick Wanta will retire at year end after nearly 29 years in the position. In
his retirement letter he wrote, “Over my many years, I am proud of the
accomplishments of the association and the industry improvement
program as we have a highly recognized safety-awareness program, 26
years of Annual Midwinter Conferences, raised over $750,000 for area
charities, and consistently maintain membership retention. We also have
a great relationship with area construction unions, local government,
and the area press plus we sell hundreds of standard specification books
throughout the state of Wisconsin. We also have outside advertising
income through advertising in various WUCA publications and website.
Other than specification book sales, none of these activities existed
when I started with the association April 1, 1987. Over the years, we
kept our overhead down and until recently went 26 years without a
contractor dues increase. Very few Wisconsin trade associations have done more for the construction
industry with such limited resources. I am proud to have served many WUCA/IIP officers, directors, and
membership these many years and will miss all the great people.” Wanta looks forward to spending time with
his family and two year old grandson. He also intends to travel as his son Erik states... “While you can still
walk, Dad.”
Federal Legislative Update
In late August 2015, the House Transportation and Infrastructure Subcommittee on Water Resources and
Environment has reached out to Clean Water Construction Coalition requesting review and comment
concerning draft legislation that provides five year funding for the Clean Water State Revolving Fund (SRF).
The draft bill is titled the “Water Quality Protection and Job Creation Act of 2015” and amends the Federal
Water Pollution Control Act. Funding ranges from $2.4 billion in federal fiscal year 2016 to $3 billion in federal
fiscal year 2020. The draft bill is in its early development stages and much more language is expected to be
added.
On a related topic, there is $5 million in President Obama’s proposed fiscal year 2016 budget for the Water
Infrastructure Finance and Innovative Act (WIFIA) to supplement funding for sewer and drinking water state
revolving funds. It may be used as a “federal credit support” for smaller communities. The 2016 fiscal year
budget would provide $1.116 billion for Clean Water and $1.186 for Drinking Water SRF’s. That is $53 million
less than in 2015.

WUCA Schedules Annual “Make-A-Wish® Fundraiser”
The Wisconsin Underground Contractors Association has
scheduled the annual fundraiser and dinner for Thursday October
8, 2015 Potawatomi Hotel & Casino Woodland Dreams Ballroom,
1611 West Canal Street, Milwaukee, Wisconsin. It will have an
American-Indian Celebration theme.
The program includes:

sponsored events. Last year WUCA conducted an Octoberfest dinner
with over 220 people in attendance. That dinner raised over $33,000
for the Wisconsin Make-A-Wish Foundation. Please plan on attending
this year October 8, 2015.

Fund trustees of conducted an open house Saturday July 25,
2015 located at W11584 State Highway 21, Coloma,
Wisconsin with over 2,000 people in attendance. The program
included great food, beverages, and live entertainment.
Trustees are spending over $10 million to expand the facility
with more classrooms and indoor winter training.

As of August 20, 2015 the apprenticeship fund has 538
apprentices. Of that number, 520 are male and 18 are female.
There are 25 minority apprentices, 44 U.S. veterans.
Regarding skill upgrading, the 2015-2016 training session
schedule will soon appear on the Operating Engineers Local
139 website. During the period 2014-2015 the fund trained
7,817 people for 104,500 training hours. The school generates
approximately $6 million in annual income.

Fund trustee Dick Wanta with Medal of Honor Winner Gary G.
Wetzel. Mr. Wetzel is a former United States Army soldier and a
recipient of the United States military's highest decoration—the
Medal of Honor—for his actions in the Vietnam War. Gary
Wetzel was a 21-year old private when he earned the medal of
honor for “conspicuous gallantry at risk of life above and beyond
the call of duty.”
Hire a Vet
The Wisconsin Underground Contractors Association (WUCA) encourages
its members to hire military veterans. Two years ago, WUCA joined with other
groups to support the military via the Employer Support of the Guard and Reserve
as we recognize and support our country’s service members and their families
in peace, crisis, and in war.

Laborers Local 113 Water & Sewer Wage Calendar Year 1955
Sixty years ago, an open cut pipe layer was paid $2.78 and a foreman $3.05 per hour in year 1955 in Milwaukee
County. The health fund contribution was seven cents per hour. In 2015, those same positions pay $34.69 and
$37.85 respectively plus $18.32 per hour in fringe benefits.
Wisconsin Laboreres Apprenticeship Fund
Rounding out our 2015 testing season we are currently sitting with 106 Apprentices for Local 113, this marks
the highest # per local to date. We have 56 @ 80%, 17 @ 85%, 14 @ 90% & 19 ready for completion @ 95%.
There were 37 new Apprentices added this season for Local 113 and over 115 new state-wide. Scheduled
testing for the year is complete and our testing dates for the 2016 season can be found on our website @
wilaborers.org. Throughout the State we have more Apprentices than we ever had, currently training over
300. The training schedule has been printed for the 2015-16 season & is also available @ our website. We
look forward to seeing everyone for training as the season draws to a close.
Operating Engineers Local 139 Health Fund
For fiscal year ending May 31, 2015 the fund had revenue of $109,976,250. Of that amount $8.7 million was
investment income. Total expenses during that same period were $108,553,696. For two months ending July
2015 the fund had revenues of $20 million compared to the same amount last year. Expenses were $15.5
million compared to $17.5 million one year prior.
Total operating engineer man-hours were up 12.2% overall statewide January thru June 2015 compared to the
same period last year due to increased construction activity.

A newly-established construction industry advisory board was established and held their first meeting August
25, 2015 at their office 2342 N. 27th street, Milwaukee, WI. Their purpose is to train and place more inner-city
residents into the construction trades. Early discussion included review of labor market statistics, available
federal funding, average age of the existing tradesperson, opportunities to hire residents, Milwaukee’s
resident preference program, staff supervision, pre-apprentices, and more. For information about the board

Employer Support of the Guard and Reser ve
Wisconsin Employer Support of the Guard and Reserve (ESGR) hosted a “Boss Lift” and employer
appreciation luncheon on May 15, 2015 at the Recruit Training Command at Naval Station Great Lakes in
North Chicago with seventeen southeast Wisconsin employers that included WUCA. ESGR would very much
like WUCA employers to hire guard and reservists.
The Boss Lift was a one day excursion aimed at familiarizing employers of Guard and Reserve members with a
taste of what their citizen service members do when participating in their military duties. The group viewed a
graduation ceremony of the Navy’s newest 5,900 newest sailors, toured the U.S. Naval Museum, and visited
the Boatswains Mate Training School. The group also received briefings from Navy leadership and ESGR on
the services provided by ESGR to support them and their military employees.
Since September 11, 2001 more than 908,246 Guard and Reserve service members across the United States
have left their families and employers to serve in overseas contingency operations or come to the aid of fellow
citizens. “Specifically, 24,074 members of the Guard and Reserve are currently deployed away from their loved
ones and places of business,” said ESGR State Chair Mike Williams “Many of these deployed Guard and
Reserve members serve, work, and live in Wisconsin. The outpouring of support from the home front has
been overwhelming. None of this could have been possible without the strong backing from civilian
employers of the brave men and women who serve this great nation, and the state of Wisconsin”, ESGR, a
Department of Defense (DoD) office, seeks to foster a culture in which all employers support and value the
employment and military service of members of the National Guard and Reserve in the United States.
ESGR facilitates and promotes a cooperative culture of employer support for National Guard and Reserve
service by developing and advocating mutually beneficial initiatives, recognizing outstanding employer
support, increasing awareness of applicable laws and policies, resolving potential conflicts between employers
and their service members, and acting as the employers’ principal advocate within DOD. Paramount to
ESGR's mission is encouraging employment of Guardsmen and Reservists who bring integrity, global
perspective and proven leadership to the civilian workforce. For more information about ESGR outreach

Appreciation weekend October 23-25, 2015. Their mission is to give an American’s hero weekend for guided

Wisconsin. The association maintains a trench rescue
trailer for educational purposes. Wayne can be called

seminars be held.
