BRIEF SUMMARY OF PRACTICE AS A BARRISTER, MEDIATOR AND ARBITRATOR
1977 - 1998
Practice as junior counsel in Australian courts appearing in wide
range of appeals, trials, arbitrations, and inquests, principally in
areas of commercial litigation, building and construction, common
law, medical and professional negligence and public liability.
Career included acting as Counsel Assisting the Royal
Commission into the Building Industry held by R V Gyles QC for
9 months.
1998 - 2015
Practice as Senior Counsel involved principally in appellate
advocacy, major inquests, class actions, complex product liability,
public liability and medical negligence trials, legal professional
disciplinary matters, alternative dispute resolution work - including
arbitrations, references out by the court and Australian and
international mediations held in Australia, Singapore and
Indonesia.

EXPERIENCE AS ADVOCATE, MEDIATOR & ARBITRATOR
My advocacy practice as a Senior Counsel currently involves appearing in major litigation,
particularly public liability, medical negligence, commercial matters and class actions. I acted
as Senior Counsel for the State of New South Wales in the recently concluded Fairbridge
class action (Giles v Commonwealth of Australia [2014] NSWSC 83).

Over 50% of my practice at the NSW Bar is as a mediator. I have acted as both mediator
and for parties in literally hundreds of disputes over more than 10 years in Australia,
Singapore and Indonesia in areas of commercial law, professional negligence, public liability,
mining disputes, infrastructure disputes, banking and commercial law.
International mediations conducted by me as mediator or conciliator in both Singapore and
Indonesia including major infrastructure, mining and professional negligence disputes.
I have been involved in arbitrations and references out by courts in Australia over many years
in areas of construction and commercial law, and most recently in disputes between insurers
in professional negligence actions.
I have been a member of the NSW Bar Association ADR Committee for many years.
OTHER INTERNATIONAL WORK AND EXPERIENCE




The only non-Indonesian who is accredited as both an arbitrator and mediator in
Indonesia. I am on the panels of arbitrators (BANI) and mediators (PMN) in Indonesia.
I am also a panel arbitrator and mediator with the Kuala Lumpur Regional Centre of
Arbitration (KLRCA).
Drafted the Mediation Rules in 2013 for Kuala Lumpur Regional Centre for Arbitration.
Member of the Australia Indonesia Business Council Committee advising on the
Economic Partnership Agreement where I had specific responsibility for advising on
the incorporation of ADR (with mediation the preferred option) in CEPA
(Comprehensive Economic Partnership Agreement) currently being negotiated
between the Australian and Indonesian governments.
PUBLIC SPEAKING AND TEACHING ENGAGEMENTS
I am frequently invited to speak at conferences, seminars, in-house tutorials and lectures,
training courses for government instrumentalities and numerous eminent private law firms in
Sydney, Singapore, Indonesia and Malaysia. I also teach at universities and for professional
associations, both locally and internationally. The subject of my teaching, presentations and
seminars includes a wide range of subjects - mediation of commercial, infrastructure and
mining disputes in Australia and Asia, professional negligence and commercial disputes as
well as sexual assault cases involving churches and schools.

In October 2009 I was a lecturer in the Dispute Resolution in Asia LLM course conducted by
Sydney University Law Faculty. I have been a guest lecturer between 2010 and 2015 at the
Indonesian Mediation Centre in Jakarta on issues of conflict resolution analysis, negotiation,
Indonesian and Western cross-cultural issues, and the role of lawyers in alternative dispute
resolution and mediation. In June 2012 and May 2014 I was a guest lecturer at the Melbourne
University Law Master’s Program on topics of mediation of medical negligence disputes, and
ethical and effective negotiations.
Other Cultural Activities
I do freelance work as a writer and photographer for numerous cultural magazines and
publications such as Asian Geographic (Singapore), and various airline and travel
magazines. A large number of my photographs and articles have been published about
numerous places in Asia including Indonesia, India, Bhutan, Mongolia and the Silk Road in
Central Asia, including cultural articles with diverse topics ranging from a non-Muslim
perspective of Ramadan to Islamic life in Sydney and the coffee culture of Sydney.
I have staged numerous photographic exhibitions in Jakarta and Sydney on topics ranging
from Indonesian people and culture to Islamic life in Sydney.
