Motions and Resolutions submitted to BSA not ratified at Council Meeting 29 May 2015 (Agenda Point 14)
MOTIONS
1. By BSA Executive
To remove paragraph 6.4.4 from the Constitution and to renumber subsequent paragraphs in the
Constitution together with any clauses which refer to paragraph 6.4.4.
Motivation
Paragraph 6.4.4 affords a party aggrieved by the outcome of an appeal decision handed down by the
Executive the right to further extend this appeal to Council. It is the view of the Executive that any
person who is subject to discipline either at Club or District level has sufficient recourse of appeal and
that a third or fourth hearing of appeal would be superfluous.
2. By BSA Executive
To amend paragraph 6.4.6 of the Constitution so as to replace reference to the Court of Arbitration for
Sport with SASCOC.
6.4.6 Any dispute arising out of or connection with the enforceability of this Constitution, or the
application and interpretation of the provisions hereof, or any dispute between any
district/member bodies of BSA or between a district/member body and the Executive or BSA
itself which has not been satisfactorily resolved by the Executive or BSA shall be referred to
SASCOC for resolution through mediation or expedited arbitration in terms of the Rules and
Procedures of Disputes in Sport prevailing at the time such dispute is so referred. In the event of
arbitration in terms of the forgoing, such resolution shall be final and binding on the parties to
the dispute.
Motivation
SASCOC is the supreme governing body for all sport in SA and therefor any disputes as a consequence of
the invoking of paragraph 6.4.6 should be referred to SASCOC for resolution.
3. By BSA Executive
To increase affiliation fees due to BSA for each member from 1 January 2016 to R190.00 p.a. VAT
inclusive. This figure includes a contribution of R40.00 to the International Fund.
Motivation
The increase is based on a consistent membership of 25 000 members. With cost increases averaging
between 6 – 7% it is the opinion of the Executive that to control our financial stability a modest increase
of R10.00 is required.
4. By BSA Executive
To amend paragraph 11.1.2 of the Constitution as follows:
11.1.2 District and member bodies shall be liable for payment of annual subscriptions for new members
who registered between 1 January and 31 December each year such subscription shall be on a pro-rata
basis calculated at 1/12 of the annual subscription payable for that year for each month remaining.
Members who were placed in clearance in the prior year/s and who have not as at 31 December been
registered with a club will be subject to pro-rata subscriptions as set out above.
Motivation
The principle of proportionate membership costs have been in effect for a number of years and the
purpose of this amendment is for the constitution to reflect actual practice.
RESOLUTIONS
1. By BSA Executive
To permanently stage the Under 19 and Under 25 ID Championships in Bloemfontein with SFS as the
host district.
Motivation
Several districts have indicated during workshop discussions that to reduce the cost of travel, they
would prefer a centralised venue.
2. By BSA Executive
To allow the Executive discretionary options in the allocation of portion of the annual subscriptions.
Motivation
In terms of a prior resolution Council mandated the Executive to set aside the sum of R40.00 (Forty
Rand) to augment international travel expenses.
During the period a reasonable sum of money has been accumulated in this fund and the Executive now
believe it appropriate to be granted discretion to allocate such portion of the R40.00 to the
Development and Capacity Building funds as is necessary to meet the strategic requirements of those
funds.
3. By Limpopo Bowls
1. That future ID Championships be split into two sections, e.g. ‘Red and Blue’ (or other suitable names)
by initially seeding entries to decide which teams are to compete in what sections.
2. That subsequent to the first year of implementation, the winners of the ‘Blue’ section be promoted to
the ‘Red’ section and the losers of the ‘Red’ section be relegated to the ‘Blue’ section after each
tournament.
3. That previous resolutions which may conflict with these decisions be rescinded.
Motivation
The Executive of Limpopo Bowls feels that the discrepancy between the player base of Districts from
Metropolitan areas and outlying Districts, is detrimental to the sport of bowls in general due to the fact
that, whilst players from outlying areas find it difficult to compete against players from Metropolis, the
latter are not stimulated to perform optimally when competing against the former.
The number of teams that competed in the Open, ‘B’ and Senior Inter-Districts, i.e. two sections of ten
teams, could easily have been split into two sections of 10 teams in a ‘Red’ and “Blue’ section.
4. By Ekurhuleni Bowls
That the National Championships open and senior singles disciplines be amended to be played on a
knock out basis with a limit of entries of 256 for the open and 128 for the senior event and without the
limits of entry per district as detailed in the current Nationals Modus Operandi.
Motivation
The knock out basis of competition is the true form of a championship.
Smaller districts will be afforded a fairer opportunity of gaining entry for their better players rather than
be limited by those slots imposed in the current Modus Operandi.
No added time would be required to complete a National Tournament if, as is the present case, three
singles games are played on one day, the competition would be reduced to the last 32 and last 16
competitors for the open and senior events in that day. This situation exists using current format.
Clashes, where the same player has reached the end stages of more than one discipline, will be no
different from those experienced under the present format.
Entry statistics of the recent National Tournament were 259 and 131 entrants for the Open and Senior
singles respectively. These figures are likely to be the highest for any of the National Championship
venues in the whole of RSA and it would be improbable that the tournament would have to juggle the
entries of the country’s foremost players to be accommodated in the draw.
Lower entry numbers need not require change to the knock out format, only the competition ladder will
need to be manipulated to reach an even number in the latter stages.
