Current Responsibilities
John Cunningham is a managing consultant for the Construction Consulting Practice. He provides
and leads client services in complex engineering and construction disputes and claims, serving as
an independent expert. He provides management consulting services in all phases of engineering
design and construction regarding claims management and claims avoidance. He is an advisor in
corporate governance and risk management. John’s expertise is in engineering and construction,
with a focus in the energy sector, including power generation, electric transmission, pipelines,
refineries, LNG facilities, petrochemical complexes, and chemical plants. His engagements also
include structures, such as high-rise buildings, and specialty issues, such as asbestos.
Experience
As a disputes expert, John performs, leads and manages client services in such matters as scope
disputes, forensic analysis, standard of care, prudence/negligence issues, errors and omissions,
roles and responsibilities of the parties and causation, delay and disruption, productivity, damages
quantification and calculation. He provides services to both contractors and owners. John has
testified as an expert in various claims proceedings and is experienced with ICC and AAA forms of
arbitration.
As a management consultant, he advises clients seeking to defend against or avoid claims or who
may need to initiate them. He performs and leads contract administration support services,
conducts project performance reviews, and analyzes engineering and construction practices in
comparison with industry accepted standard of care.
As an advisor in corporate governance and risk management, John’s experience includes project
risk management evaluations and risk management training sessions. Having extensive
experience drafting and negotiating numerous types of contracts and financial instruments, he also
performs contract controls assessments.
John offers over three decades of practical industry experience as a project developer, contract
negotiator, engineering officer, project construction manager, asset manager and board member of
various complex energy projects, many on the order of US$1 billion in size. Prior to joining Marsh,
John was an engagement manager for The Nielsen-Wurster Group, Inc., a dispute resolution,
management consulting and risk management services company whose assets were acquired by
Marsh USA, Inc. Before then, John was employed for 30 years at El Paso Corporation, culminating
as an engineering officer. Early career responsibilities included involvement in many FERC
regulatory and certificate matters and service as a plant engineer at a petrochemical complex.
