This issue highlights illustrative events. Our alumni continue to excel in the "real world" of practice. Matt Wood spent a year in Australia with an international law firm and his story is in this issue. Our faculty continue to be productive scholars as well as teachers. Allison Professor Tom Baker was re-appointed to the Standing Committee on Rules of Practice and Procedure for the United States Courts, served as a Fulbright Professor and Scholar in Residence at the National and Capodistrian University of Athens in Greece, and published essays, book reviews, law review articles and a lengthy study and report commissioned by the Federal Judicial Center for Congress. Professor Dan Benson completed a criminal law casebook, published by the Michie Company, and a law review article entitled "The Crime Control Act of 1990 and Other Criminal Laws Affecting Bank Counsel." Professor Chuck Bubany participated in the Texas Association of Counties Judicial Education Institute, will present a paper at the North American Family Law Conference, and continues to contribute as a regular author to the Family Law Section of the State Bar General Practice Digest of Cases. Professor Wes Cochran's article entitled "Why Can't I Watch This Video Here?: Copyright Confusion and Performances of the Videocassettes and Videodiscs in Libraries has been accepted for publication in the Hastings Communication & Entertainment Law Journal. He has been appointed to the Recruitment Committee of the American Association of Law Libraries, to an ABA!AALS Site Evaluation team, and has been invited to give several speeches and presentations throughout the United States. Professor Bill Piatt completed his book entitled Language on the Job and it was published by the University of New Mexico Press. He was also recently named to the American Bar Association's Standing Committee on Lawyer Competence. Adjunct Professor Rey Valencia has been asked to serve on the Board of Editors of the newly-established Harvard Latino Law Review and to deliver the keynote address at the annual Harvard Latino Alumni Association Spring Conference. Teaching remains our primary mission, but it is clear by any standard that the faculty at the Texas Tech School of Law also serve in positions of national leadership and produce an impressive body of scholarship. Our alumni support continues unabated. This issue of the Cornerstone contains our Annual Giving Report. Our alumni and friends continue to respond in record numbers and with record gift amounts. Our alumni and friends have completed contributions which fully endow the 1. Hadley Edgar Professorship of Law. Our annual gift program provides the kind of continuing support to the Texas Tech School of Law which helps to fill the gap left by reduction of state funding. We are lucky to have a large and effective group of committed alumni and friends. We now have alumni directories available for sale and we ask that you pay attention to the notice in this issue of the alumni meeting to be held at the State Bar Convention in Fort Worth. The icing on the cake relates to our Law School renovation and Law Library expansion project. The cover story details the Regents' approval of our construction contract. As I draft this letter, construction is well underway. There is some real dis allocation for those of us using the building during construction. Nonetheless, we are excited as we see these major changes take place. Please mark your calendars and plan to be with us on Friday, May 13, 1994. Our formal rededication of the building will take place at that time and you will receive more information on this special program next fall. We plan to celebrate the 25th anniversary of the Texas Tech School of Law in our building. Frank Newton Dean 3 ~C~O~V~ER~________~______________ STORY ~ Regents Approve Construction Contract For Library Renovation QUESTION: When is doing legal research hazardous to your health? QUESTION: When is the Forum not the Forum? ANSWER: When the law library is under construction. 4 Picture, if you can, the library circulation desk in the Forum. The rug is rolled up and stacks of books are arranged throughout the space. The sofas, chairs, tables and plants from the Forum are in the hall outside Room 109. The Law Review is located in the Placement Office and the Board of Banisters meets in the jury room by the Courtroom. Hard hats are recommended for library patrons. The law library staff is dispersed throughout the building and only the classrooms remain the same. Construction of the law library addition began in December, 1992. Upon completion, the law library will: • be wheelchair accessible on all floors; • have additional canels for students; • have every canel fully wired and fitted for computer-assisted legal research; • have renovated Law Review, Board of Banisters, Texas Bank Lawyer and Legal Research Board offices on the third floor; • have 13,000 square feet of additional floor space; and • be the law library that provides students with the ultimate research capabilities (400 individual terminals!). The $4.0 million dollar renovation will fully outfit the Texas Tech School of Law for the 21st century. "Our students will have the opportunity to become proficient in computer assisted legal research to a greater degree than in any other law school in the nation," said Newton. ____________~~--------~FA~C~U~L~T~Y ~ NEWS THOMAS E. BAKER Professor Baker returned from Greece where he was a Fulbright professor and scholar in residence at the National and Capodistrian University of Athens, School of Public Law. Baker taught a seminar on American Constitutional Law and also lectured at the two other universities in Greece. Prof. Baker also published: 15 assorted essays in THE OXFORD COMPANION TO THE SUPREME COURT OF THE UNITED STATES (K. Hall, ed. 1992); Book Review: Frank M. Kemerer, William Wayne Justice - A Judicial Biography, 8 CONSTO. COMMENTARY 361 (1992); Religious Convictions and Professional Education, 1 PROFESSIONAL ETHICS 3 (1993); A Legislative History of the Creation of the Eleventh Circuit, 8 GA. ST. UNIV. L. REV. 363 (1992). In summer of 1992, Prof. Baker completed a lengthy study and report about the problems of the U.S. Courts of Appeals, commissioned by the Federal Judicial Center for the Congress. He is a member of the Board of Editors of the Texas Lawyer and a Contributing Editor of the Preview of United States Supreme Court Cases, and he writes regular columns and previews. Prof. Baker also serves as a member of the Board of Editors of the Journal of Supreme Court History. The Chief Justice recently reappointed Prof. Baker to a second 3-year term on the Standing Committee on Rules of Practice and Procedure for the U.S. Courts. In February, 1993 Prof. Baker was on the program at the National Workshop for Judges of the U.S. Courts of Appeals, in Washington, D.C. This was only the second time all the circuit judges were convened for a conference. In March, ] 993, Prof. Baker participated in a faculty colloquium with Justice Scalia at the Loyola University School of Law in New Orleans, Louisiana. International Society of Family Law's North America Family Law Conference at Jackson Lake Lodge, Wyoming. The paper is titled, "Professional Responsibility Implications of Family Restructuring in the Context of Client Counseling." WESCOCHRAN Law Library Director Wes Cochran presented a speech, "How Time Flies: Time Management for Librarians," at the 1993 Annual Conference of the Louisiana Library Association in Shreveport on March 25. He has worked all year as one oftwo Co-Directors for one of the 1993 Institutes for the American Association of Law Libraries. His institute, "Leadership and Management Skills," will be held July 5-9, 1993 at the Western New England College School of Law in Springfield, . Massachusetts. Director Cochran's article, "Why Can't I Watch This Video Here?: Copyright Confusion and Performances of Videocassettes and Videodiscs in Libraries," was accepted for publication in the spring 1993 issue of the Hastings Communication & Entertainment Law Journal (COMMlENT). Director Cochran was recently appointed to the Recruitment Committee of the American Association of Law Libraries for 1993-95, and he was also appointed to the Site Evaluation Team for the ABAlAALS reaccreditation inspection of the University of Arkansas-Fayetteville School of Law. The Medical Library Association invited Cochran to write the Capital News column for the April and May issues of MLA News. The columns will address the recent decision, American Geophysical Union v. Texaco, 802 F.Supp. 1 (S .D. New York, 1992). DAN BENSON BILL PIATT Professor Dan Benson has completed work (with three co-authors, John S. Baker, Jr., L.S .u.; Robert Force, Tulane; and B.J. George, Jr., New York Law School) on the Fifth Edition revision of HALL'S CRIMINAL LAW: CASES AND MATERIALS, to be published this summer by The Michie Company. Prof. Benson also published an article entitled "The Crime Control Act of 1990 and Other Criminal Laws Affecting Bank Counsel," in the Banking Law Symposium Issue of the Consumer Finance Law Quarterly Report (Fall 1992). Professor Piatt' s latest book, "Language on the Job: Balancing Business Needs and Employees' Rights" was published in March 1993 by the University of New Mexico Press. The book is the first full discussion of language issues arising from rapid changes in the workforce. Prof. Piatt' s goal is to provide guidance that minimizes conflict over these issues in the labor market. Prof. Piatt was also recently named to the American Bar Association's Standing Committee on Lawyer Competence. CHARLES BUBANY Professor Bubany is participating in the Texas Association of Counties Judicial Education Institute sponsored by the Texas Tech School of Law in Lubbock on May 4-7 . He will speak on Family Violence on May 5 and Probable Cause on May 6. Prof. Bubany will also be a speaker at the May 20, 1993 Texas Department of Public Safety DWI-Driver Improvement Seminar on Attorney Client Relationships (Ethics). Prof. Bubany continues to author on a regular basis the Family Law Section of the State Bar General Practice Digest of Cases. In June, 1993, Prof. Bubany will present a paper at the REY VALENCIA Adjunct Professor Rey Valencia has been asked to serve on the Board of Advisors of the newly-established Harvard Latino Law Review. In addition Prof. Valencia has also been asked by La Alianza, the Latino law student organization at the Harvard Law School, to deliver this year's keynote address at the annual third-year banquet, which is held in conjunction with the annual Harvard Latino Alumni Association Spring Conference. This year the theme of the Spring Conference is "The North American Free Trade Agreement and Its Ramifications for the Latino Community." The title of Prof. Valencia' s keynote address is "The Silence Which Is Courage." 5 ~P~RO~F~E~S~S~O~R~SH~I~P___~~___________ COMPLETED ~ J. Hadley Edgar Professorship Completed 6 Dean W. Frank Newton announced to the Texas Tech Law Foundation Board of Trustees on April 22, 1993 that the 1. Hadley Edgar Professorship has been completed. At a dinner honoring Professor Emeritus Edgar that evening, major contributors Richard C. Hile ('74) and Martin W. Dies III ('74) were recognized for their contributions to the professorship. $75,000 of the $150,000 endowment necessary to fund the 1. Hadley Edgar Professorship was provided by a Challenge Grant made at the outset by Richard C. Hile and Martin Dies III. A substantial portion of the remaining endowment came from two Special Donors, Frank Branson and Wayne Reaud, and from 17 major donors . Board of Trustees members Tom Hall, John Huffaker (representing Gibson Ochsner and Adkins), Roger Key, Brian Loncar and John Simpson were also recognized for their part as major donors in making the Edgar Professorship a reality. After taking the February 1990 bar exam, Matthew and his wife, Beth, moved to Melbourne, Australia to work with Arthur Robinson & Hedderwicks ("AR&H"), the oldest and one of the largest firms in Melbourne. Founded in 1897 by Sir Arthur Robinson, KCMG, AR & H is a member of the Australian Legal Group, a consortium of firms with offices in every major city in Australia, as well as New York, London, Hong Kong, Singapore, Jakarta and Tokyo. A search through the Martindale Hubbell directory in the law school's placement office provided Matthew with the name and address of the firm with which he was to become associated. After numerous correspondence and telephone calls, Ian Renard, the Managing Partner of AR & H, arranged for Matthew to be interviewed by one of their Senior Associates who was on a year-long assignment at the San Francisco office of Thelin, Marrin, Johnson & Bridges. AR & H hired Matthew as a "Foreign-Licensed Attorney". As Australia is a Commonwealth country, their legal system uses the Barrister/Solicitor method. Law firms are made up of solicitors, similar in many ways to transactional attorneys. When issues are to be determined in a court, a solicitor (not the client) will pick a barrister to try the case. Barristers are independent, and must be hired by a solicitor. The solicitor would then draft a file brief for the barrister to present in court. Matthew practiced as a solicitor in the Security Matthew Wood '89 (left) with Peter Hayes, Q.c. in Melbourne, Australia. Enforcement and Corporate Insolvency Group. The laws (especially commercial and banking) are sufficiently similar to those in the U.S. that Matthew was able, with the assistance of the firm's extensive internal training program, to quickly become functional in practice. He said that practicing commercial law at AR & H was not really much different from large firm practice in any major U.S. city, except that he was surprised with how quickly he was given client responsibility and development opportunities. For the first nine months, Matthew was part of a team involved in the largest commercial litigation matter in Australian history. His firm represented "junk bond" holders who held a $2 billion (US $1.5 billion) worth of debentures in Bond Brewing, the large beer and hotel corporation founded by Alan Bond. You might recognize Mr. Bond's name, as he was the yacht owner and financier behind the Australia's successful America's Cup team. As these "junk" bonds were originally sold in New York through Drexel Burnham Lambert, several issues of fact and law required determination in New York, and then finding a comparable relationship in Australian law. This trial was in and out of court for several months . Because of the people involved and the amount of money, the media followed the proceedings very closely. Unfortunately for the media but fortunately for AR & H's clients, the case was settled out of court, with a substantial payout to bond holders. In 1991 several "Savings Societies", similar to U.S. Savings and Loans, failed. Matthew's group did numerous refinancing agreements, including several foreign owned or foreign bank-financed arrangements. He also instigated collection proceedings and "winding ups" (corporate bankruptcies) and performed bank investigative "due diligence" work. Since Melbourne, like all major Australian cities, is coastal, Matthew and Beth took the opportunity to live on the beach in a two story "flat", which was quite a change from Lubbock. They spent most of their leisure time sailing, cycling and traveling around the country. Matthew has recently returned to Dallas, where he is a partner with Marshall Ashley ('89), formerly of KPMG Peat Marwick, in a boutique commercial and international practice as Ashley & Wood, 3400 Fountain Place, 1445 Ross Avenue, Dallas, Texas 75202. The firm practices globally, with an emphasis in Pacific Rim Commercial work. The firm has close working relationships with major legal and professional firms throughout Asia and the Pacific, as well as numerous European and South American contacts. According to Matthew, "Working with a major Australian law firm was a fantastic introduction to the practice of law and an exciting way to enter the international legal field!" ______________~~______S~T~U~D~E~N~T ~ NEWS ALUMNI MEETING AT STATE BAR MEETING Please join Dean Newton and your fellow alumni for a reception during the State Bar of Texas Convention.
