H i s M a j e s t y ' s / G o v e r n m e n t ' s v i e w s o n t h e s t a t u s of F o r m o s a w e r e
s e t o u t i n t h e r e p l y g i v e n b y t h e F o r e i g n S e c r e t a r y o n 15th F e b r u a r y , 1 9 5 0 ,
to an e n q u i r y by the Chief J u s t i c e , Hong Kong. T h i s r e p l y w a s as follows:
" I n 1943 F o r m o s a w a s p a r t of t h e t e r r i t o r y of t h e J a p a n e s e
E m p i r e and His M a j e s t y ' s G o v e r n m e n t c o n s i d e r t h a t F o r m o s a is still de j u r e
p a r t of t h a t t e r r i t o r y .
O n 1st D e c e m b e r , 1 9 4 3 , a t C a i r o , P r e s i d e n t R o o s e v e l t ,
G e n e r a l i s s i m o Chiang K a i - s h e k and P r i m e M i n i s t e r C h u r c h i l l d e c l a r e d that all
the t e r r i t o r i e s that Japan had stolen f r o m the Chinese, including F o r m o s a , should
b e r e s t o r e d t o t h e R e p u b l i c of C h i n a .
On 26th J u l y , 1945, at P o t s d a m , t h e
H e a d s of t h e G o v e r n m e n t s of t h e U n i t e d S t a t e s of A m e r i c a a n d t h e U n i t e d
K i n g d o m a n d t h e R e p u b l i c of C h i n a r e a f f i r m e d t h a t t h e " t e r m s of t h e C a i r o
D e c l a r a t i o n should be c a r r i e d out". (The P o t s d a m D e c l a r a t i o n was s u b ­
s e q u e n t l y a d h e r e d t o b y t h e S o v i e t U n i o n ) . On 2 5 t h O c t o b e r , 1 9 4 5 , a s a r e s u l t
of a n O r d e r i s s u e d o n t h e b a s i s of c o n s u l t a t i o n a n d a g r e e m e n t b e t w e e n t h e
A l l i e d P o w e r s c o n c e r n e d , the J a p a n e s e F o r c e s in F o r m o s a s u r r e n d e r e d to
Chiang Kai-shek.
T h e r e u p o n , w i t h t h e c o n s e n t of t h e A l l i e d P o w e r s ,
a d m i n i s t r a t i o n of F o r m o s a w a s u n d e r t a k e n b y t h e G o v e r n m e n t of t h e R e p u b l i c
of C h i n a . A t p r e s e n t , t h e a c t u a l a d m i n i s t r a t i o n of t h e i s l a n d i s b y Wu K u o - c h e n g ,
who h a s not, so far a s His M a j e s t y ' s G o v e r n m e n t a r e a w a r e , r e p u d i a t e d the
s u p e r i o r a u t h o r i t y of t h e N a t i o n a l i s t G o v e r n m e n t . "

it-will be r e a l i s e d t h a t w h a t e v e r we s a y is likely to s u b j e c t our p r e s e n t
difficult r e l a t i o n s with China to an even g r e a t e r s t r a i n ; p a r t i c u l a r l y would
t h i s b e t h e c a s e if w e s u p p o r t A m e r i c a n a c t i o n o r n o w r e s t a t e o u r v i e w t h a t
F o r m o s a is not C h i n e s e t e r r i t o r y . S i m i l a r l y , w h a t e v e r we s a y m a y h a v e
r e p e r c u s s i o n s in t h e U n i t e d S t a t e s , w h e r e f a i l u r e on o u r p a r t t o e x p r e s s c l e a r
s u p p o r t m i g h t w e l l l e a v e u s o p e n t o t h e c h a r g e of " d r a g g i n g o u r f e e t " .
It w o u l d
t h e r e f o r e s e e m a d v i s a b l e to m a k e no s t a t e m e n t u n l e s s the q u e s t i o n i s r a i s e d
i n t h e c o u r s e of t h e d e b a t e .
Recommendations
(i)
N o s t a t e m e n t s h o u l d b e m a d e u n l e s s t h e q u e s t i o n of o u r a t t i t u d e
t o t h e A m e r i c a n a c t i o n in F o r m o s a , a n d w h e t h e r w e s u p p o r t it o r n o t ,
is d e f i n i t e l y r a i s e d in s u c h a w a y a s to r e n d e r s o m e a n s w e r u n a v o i d a b l e .

G r e a t P o w e r s d e c i d e d a t C a i r o o n 1st D e c e m b e r , 1 9 4 3 , t h a t i t s h o u l d
b e t a k e n f r o m J a p a n a n d r e s t o r e d to C h i n a , but, f r o m the l e g a l
p o i n t of v i e w , t h e J a p a n e s e s o v e r e i g n t y o v e r F o r m o s a m u s t b e
extinguished by a p e a c e t r e a t y or s o m e s i m i l a r i n s t r u m e n t .
I t i s t r u e t h a t , i n a n t i c i p a t i o n of s u c h a p r o v i s i o n in t h e p e a c e
t r e a t y , the C h i n e s e G o v e r n m e n t w e r e p e r m i t t e d or invited to
a s s u m e a d m i n i s t r a t i o n of F o r m o s a , a n d t h e y d i d s o . A t p r e s e n t ,
h o w e v e r , t h e y a r e in F o r m o s a a s a n a d m i n i s t e r i n g a u t h o r i t y m e r e l y
b y t h e w i l l of t h e A l l i e s , a n d i n m a t t e r s r e l a t i n g t o J a p a n , b y
Allied a r r a n g e m e n t s , the United States G o v e r n m e n t take the lead.
T h e r e f o r e the United States G o v e r n m e n t w e r e not w r o n g when they
s a i d t h a t t h e u l t i m a t e s t a t u s of F o r m o s a h a d t o b e d e t e r m i n e d b y a
p e a c e t r e a t y o r , i n t i m e s of c r i s i s , i n d i c a t i n g t h a t t h e y w o u l d e x e r c i s e
a c e r t a i n s u p r e m e c o n t r o l so far a s F o r m o s a is c o n c e r n e d . "
A n o t h e r l i k e l y l i n e of c r i t i c i s m i s t h e f o l l o w i n g :
"The United
S t a t e s p u r p o r t s to r e c o g n i s e the Nationalist G o v e r n m e n t a s the
d e j u r e G o v e r n m e n t of C h i n a . B u t it h a s p e r e m p t o r i l y o r d e r e d t h e
C h i n e s e N a t i o n a l i s t G o v e r n m e n t t o c e a s e a l l o p e r a t i o n s in t h e c i v i l
w a r w h i c h a r e c o n d u c t e d in i t s e n d e a v o u r to r e c o v e r C h i n e s e
t e r r i t o r y f o r t h e b e n e f i t of t h e G o v e r n m e n t w h i c h t h e U n i t e d S t a t e s
s a y s is the de j u r e G o v e r n m e n t , and a g a i n s t a u t h o r i t i e s which,
i n t h e v i e w of t h e U n i t e d S t a t e s a r e m e r e u s u r p e r s , n o t r e c o g n i s e d
by the United States as a g o v e r n m e n t at all. "
T h e a n s w e r t o t h i s q u e s t i o n i s d i f f i c u l t , b e c a u s e it i s h a r d t o
r e c o n c i l e this p a r t i c u l a r United States O r d e r with the p r e s e n t United
S t a t e s r e c o g n i t i o n p o l i c y in C h i n a , a n d b e c a u s e it s h o w s t h e U n i t e d
States treating the Chinese Nationalist Government practically as a
p u p p e t in t h e i r h a n d s . T h e b e s t a n s w e r m i g h t be t h a t , a p a r t f r o m
the fact that this p a r t i c u l a r United States o r d e r , which the Chinese
N a t i o n a l i s t s h a v e a c c e p t e d in p r i n c i p l e , is v e r y b e n e f i c i a l to B r i t i s h
i n t e r e s t s b e c a u s e it s h o u l d p u t an end t o a t t a c k s m a d e on B r i t i s h s h i p s ,
it c a n a l s o be s a i d t h a t t h e s e C h i n e s e o p e r a t i o n s w e r e c o n d u c t e d f r o m
F o r m o s a , which the C h i n e s e N a t i o n a l i s t s at p r e s e n t only hold as
a d m i n i s t r a t o r s a t t h e i n v i t a t i o n of t h e A l l i e d P o w e r s .
